On November 1, my previous mortgage company sold my loan to Ocwen Federal Bank. I have never been late on a payment in 4 years of owning a home.

My mortgage payment is automatically debited from my checking account by an Equity Accelerator agency ("EA"), who forwards it to the mortgage company.By the third week of November, I was getting 3 calls a day from Ocwen, saying I was delinquent for November.

The EA had made my mortgage payment, but to the old company, as Ocwen did not notify me or them of the new loan number until November 8. The EA forced Ocwen to drop delinqency threats and the payment mix-up (caused by Ocwen) was resolved in December. Then in January, I again began getting multiple calls from Ocwen saying I was delinquent for January and owed over $4,200, including late fees.

I checked and the EA had made my January payment on Janiary 6, at the rate of $2,555. On January 18, Ocwen notified the EA that the payment was now $2,927.

Because they had not received that amount on January 6 (as they had not notified the EA of the change) Ocwen did not apply the January payment to my account, but put it in a "suspense account" and declared me delinquent on my January payment.

The EA and I jointly called Ocwen on February 7, and Ocwen said I was delinquent on the January and February payments, hence the figure of over $4,200. Ocwen admitted they had received a January payment, but had not applied to my mortgage account, instead putting it in the suspense account and presumably earned interest on it for themselves while also saying I owed late fees of $175.

The EA informed Ocwen they had electronically sent funds to make up the January shortfall, following the Janaury 18 notice of the change, and also for the new rate for February. On the same day, I received a delinquency notice from Ocwen's lawyers, saying I was delinquent as of January 31 for January and February (how I could be delinquent for February on January 31 is a mystery.)

The EA personnel tried to reach the "right" people at Ocwen all day on February 7 without success, to getthe late fees removed, and are continuing.in the meantime, I am trying to refinance with another bank to out of this mess. Both the EA and I have documented all paperwork and kept records of the phone conversations.
