My husband and I have also been victims of Ameriquest; on June 12, I went to the mailbox and found a letter that I could still save my house from sone random attorney (ones after money, just advertising, checking court filings, ets.). I was confused, because as of that date, my house payment was up to date. I read the letter, called the company, who them immediately transfered me to Citibank (who allegedly took over my mortgage from Ameriquest when they went bankrupt). I was told that our file had been turned over for forclosure and that I could, like Andrea, file paper work to reduce my rate, and save my home. Jose (the employee) took my information, gave me the web address, told me to fax the paper work, that it could take up to six weeks, and that the underwriters are slow, etc. (this confused me and I asked questions but was givent the run around... Why would I need to reduce my rate and where had my money gone?) But you will do anything to save your home. First, the web address I was given was non-existent, I had to call again. Still came up empty handed. I called again, was told a copy was in the mail anyway, just wait for it. A week passes, try the web address and call, was told that the paper was mailed out that day, the 20th of June. I finally get the paperwork on July 1st, after a million attempts at the web address and a million and one phone calls.

When I get the paper work, it says that I have to have the papers submitted by June 23rd at midnight... 8 days before then. When I call to complain, I am told that I did not respond in the allotted time, therefore they could not do another financial review for another three months (I do have the names of all I talked to). Like every other time previously, since june 12th that I had spoke to them, I asked again how could I be in foreclosure if I was current on my house payments, and again I was told that I was 3 months behind, like before I faxed them proof of all payments for a year and was told again, that I was behind??? On July the 9th, I get the mail, there is a letter from a couple that buy homes in our neighborhood, offering to buy our home. I was confused, about 2 hours later, we were served papers filing for motion of default. I immediatley called an attorney, I was seen in his office, we set up to file chapter 13 to save our home. This has set the wheels in fast forward; it is like they want your house no matter what. Hopefully we are will save our home; but I am disgusted.

Our attorney told us that some companies will foreclose even with full payment, and insist that you are behind. Since we have proof, we have been told that those months will get reimbersed or something. Honestly I can't remember. We now have received a letter from the now defunct Ameriquest saying that they did not practice truth in lending on our mortgage loan, saying that basically we were tricked into signing a phony document that was not represented correctly, etc. My point is that this company and its trust (who do not have to operate by given rules) has preyed on people and caused them to lose or possibly lose everything they own with no warning. And before anyone wants to get on their soap box, my husband and I had spotless credit when we bought our house, we made a bad choice in a predatory lender but found out too late. We have been told by our attorney and by others in our situation that as soon as you sign your name to that mortgage, they are planning on foreclosing on your home. We did not get a subprime loan, we got preyed upon by a mortgage company that made itself out to be something that it wasn't.

To this day, we never have received anything from Citibank/Ameriquest that says we are in default, as a matter of fact we just received a statement from them saying our house payment was going down because of over payment on our escrow... WTF??? I had no idea that this was even a possibility, but I am learning that this is more common than people think. As for any alleged Ameriquest employees, there are none, they are CitiBank employees, and they are being told one thing while the company they work for does another; it is very sad that this company has destroyed lives, they should be ashamed!!!
