Refuses to honor Sailors and Soldier Relief Act

When I was deployed to Qatar I informed Emerge Credit Card Co. That I was entitled to an interest discount under the Sailors and Soldiers Relief Act. Emerge sent me forms that needed to be certified and returned along with a copy of my orders.

After getting the form certified, I mailed the form along with a copy of my Active Duty Orders and a copy of my Power of Attorney authorizing my husband to conduct business on my account in my absences. All these forms where mailed by Certified Mail. Seven days later, Emerge Card signed the Post Office form stating that they had received the forms.

After waiting one billing cycle and noticing no change in the interest rate, Emerge Card was notified and questioned as to WHY nothing had been changed on the account. Emerge Card stated that they had never received my documents. When I informed them that I had a signed receipt stating that they had received the documents, they said they would check into it.

Two weeks later I received a letter stating that I needed to send them the original set of Active Duty Orders (which the Military does not give to any one) and they sent me another form to be certified again.

I called Emerge Card and asked them if they had on file a copy of the Power of Attorney that I had sent them. They stated that it was on file. So my next question was, how is it possible to have the Power of Attorney on file, But none of the other documents that was sent since they were all in the same envelop. They could not explain how it happened but stated that I needed to return the new forms that they had just sent me again.

These form were taken to the Military Legal Aid, who in turn filled them out, certified the forms and mailed them back to Emerge credit card Co. After waiting another month, Emerge again states that the forms were never received.

Not only have these forms been mailed to Emerge, but they were also FAXED three (3) times, mailed twice (2) and more than 10 phone calls to Supervisors and to date, Emerge Credit Card Co. Keeps stating that they have not received any of the documents. I still can not understand that if Emerge has not received any of the documents, HOW did they get the Power of Attorney?

As of today, 60 days have past and Emerge continues to deny receiving any communications concerning this account and continues to charge my account 28% interest monthly.
