FYI, it is illegal for banks to charge fees on payroll checks drawn upon their accounts per California Labor Code 212. The law regulates the payment of wages by check and requires such checks to be (1) negotiable, (2) payable in cash, (3) on demand, (4) without discount (5) at an established place of business in the State, (6) the name and address of which appears on the instrument, and (7) which place of business has been prepared, by the deposit of funds, the establishment of credit, or by some arrangement or understanding, to pay the money called for by the instrument. Therefore, if a bank tries to charge a fee for cashing a payroll check drawn upon their bank, they are violating this law.

A class action lawsuit has already been filed against Dollar Tree for violating this law, and they have been fined $100 for the first violation and $200 for every subsequent violation.

Granted, it is the company, not the bank getting fined. However, banks need to made aware of this.

Also, if your company is paying you a paycheck drawn on an out of state bank and there are no branches in California for you to cash the check, they must provide you with a place to cash the check or they are violating this code.
