I refined my mortgage with Argent Mortgage co in November with promises of a better deal. After a short period of of time, I was notified that6 my mortgage was being transfered to AMC Mortage co. This went along fine until i received a letter from them stating I was behuind in payments. After reviewing all my prevoious bank statements, i sent a letter off to the mortgage company explaining the error on their part and provided proff of payments. I continued to receive letters from the company stating that i was still behind on payments and that foreclosure procedures was in the process.
I immediately contacted an attorney and filed chapter 13 bankrupcy to avoid losing my home. After appearing in court and being ordered an court order to pay for supposely missed payments, the company accepted only two of the court payments. At this time AMC mortgage refused to accept payments on the loan saying I was in default. After several attempts to reach the company via phone, email and their attorney to no avail. I received a letter from AMC mortgage that my loan was being transfered to Citi Residental Lending and they had also filed foreclosure proceeding against the property.
After trying to reach the new company via phone.By the way turned out to be number for previous company. I tried to mail the mortgage payments to citiresidential leading only to have them returned as "currently on a Home Retention Group Plan and this is not the agreed amount according to the plan". They left a phone number to call. But if you call the number either the person who answers the phone can't help you or you only get voice mail to leave a message where noone ever returns the phone calls.
I received an another notice that my home was going to foreclosure again.By the time the letter was received at my home address. I had less than a week to try a block the pending sale of the home.
We have gone to court over this issue and the judge sided with the lawyer for the mortgage company. Currently i'm appealing the decision, but according to the judge the home has been sold and ratified through the court system. At the present time, i'm in the process of moving and trying to clear the bad reputation these companies have given my name let alone missed up my credit.
