Still holding Tax Levy that was Lift and charging me overdraft fees, Cincinatti, Lexington

It is more simple to explain in the copy of the letter I sent to internet address, as no one in Customer Service will 'communicate', except to 'talk down' to you as if you could not possibly understand all the complexities of the laws. Yes, that's right, they are simply following 'legal' procedures, but YOU or even the Sheriff's department cannot talk to their 'legal' department.

Following is my explanation to 'them', whoever that is that looks at communications on the website.

I apologize in advance at the negative tones in my explanation, but I am extremely upset about my 'missing' money in the amount of, $*, *.*

WHERE IS MY MONEY??? I was sent an email on Friday evening, July 11. I received it on Saturday. It told me to go to the online site for a message. The message was all my money was gone, and a check bounced to my Gas Company (which I did receive a fine for, plus a disconnect notice), and a stop payment to my mortgage company (which I had to pay late fees to and the $9.00 service charge when I repaid it.

I had to drive 40 miles roundtrip to my branch of origination to find out my money was seized due to a Tax Warrant. (It was a Mistakeand first time I ever heard of such a thing, they had wrong person.)

I had to wait until Monday morning when Sheriffs department opened to find out what was going on. The matter was settled by noon, and by 12:45 pm, July 14, Fifth Third legal department had been notified to lift the levy. I was told by my branch customer service manager, MY money would be back in my account by end of the day, or within 24 hours.

After checking back with CS Mgr. At least twice daily, it was finally determined on Thursday, July 17, that Fifth Third no longer had my money. (If a cashiers check is issued by Fifth Third and no one ever cashes it, who has that money? Where is that money?) I was told Sheriffs department was holding it.

The Marion County Sheriffs department said they did not have the money but would try to get this straightened out. On Friday morning, July 18, I was informed by them, they still did not have the money, and Fifth Third Bank legal department was not taking their calls.

My branch CS Mgr. Notified them that the legal department would NOT take or return their calls, as Fifth Third legal department, after mailing out Cashiers Checks on a tax levy, considers the matter closed (even if the Tax Levy has been lifted).

Friday, July 18, I was notified by Sheriffs department that the check had arrived in the days mail, and I was to come and get it along with proof of identification.

After signing legal documents stating I received check, they endorsed the check back to me, and I went straight to Fifth Third bank to deposit. There I was told I could not deposit the check because the Marion County Sheriffs Department did the whole procedure wrong.

I cannot put my money back into my account. However i can pay $9.00 for every check that posts to my account until fifth third legal department tries to clear the matter up which i was told could take two weeks!!!

Question: where is my money? Fifth third does not have it, marion county sheriffs department does not have it, i do not have it. The cashier's check was issued by fifth third bank.

Fifth Third Bank Legal Department has official documents dated July 14 lifting the Tax Levy.

Why cannot someone figure out what to do with this money cashiers check? Put it back into my account so I can pay my bills without the $9.00 service charges on every check. (This is where 5th 3rd helped me, instead of the usual service charges, and returning checks, they are sliding all my bill payments to my credit card and charging me $9.00 each time they do it.)

Teach the Marion County Sheriffs department the proper procedure on your own dime and quit sitting on my money drawing interest on it, while I pay you $9.00 service fees.

*I am no longer in possession of the cashier's check. Fifth Third Bank took it when I gave it to them to put back into my accounts, and gave me a 'photocopy' of the original. I did not sign it, but the head of the Marion County Sheriff's Department signature is on it with a 'Pay to the Order of 'my name'. Marion County Sheriff's Department also had me sign 2 legal documents stating they turned it over to me and what it was, plus they verified my identification.
