To anyone that can help me: A few years back I lost my job, was forced to sell my house and was unable to continue my credit card payments. Last year, Cambece inherited one of my cards from the collection agency Cache LLC. They sent me letters with settlement offers that I ignored because of no money. They then sent me a notice to appear in court which I did not. THEN I received a letter from the Deputy Sheriff saying in big bold type YOU ARE IN CONTEMPT OF COURT AND A WARRANT HAS BEEN ISSUED FOR YOUR ARREST. The letter continued with You are directed to call the Deputy Sheriff within 48 hours at #-#-# of receipt of this notice to arrange for a court appearance or to pay the total amount owed. Failure to comply will result IN YOUR IMMEDIATE ARREST. You will be held in our jail facility until the next sitting of the court. You will also be responsible for the additional fee of $300.00 in the event of your arrest.
It said at the bottom of the letter that the DMV was notified.
Upon receipt of the letter I thought it was a scam, that it was impossible to be arrested for UNSECURED credit card debt!!! I actually still do think it is a scam. But, alas, I called the law office, came to a settlement, and "avoided" court embarrassment.
Wouldn't you know, credit card # 2 is up to bat, and I just received the same letter. I called J.A. Cambece regrettably to make another deal. My principal balance was 8600. The rep Douglass Barrett (sure it isn't his real name) said they would settle for $5400. I said don't have it, then he said $4700 was as low as he could go. I offered 33% of the principal balance or $2880. He said he would see me in court.
Apparently I am going to be arrested any minute now. It's been 3 days since my 48 hour deadline!
Can somebody PLEASE tell me. Can I be arrested for unsecured cc debt? Do I have to go to Court for real? Can they garnish my wages at work. As far as I'm concerned, I've paid so much more than these credit card companies lent me in the first place, they can go fly a kite. They are the REAL CRIMINALS!!!
