In March I was forced to file bankruptcy due to fraudulent charges brought against me by the City of Renton
Our bankruptcy attorney Kevin Hogan mentioned we had to include all debt in the bankruptcy so the vehicle was listed even though we intended to continue paying on it.
It is now 3 years later and the wife and I are trying to refinance our home. When we checked our credit, Ford Motor Credit was showing that the debt was delinquent and discharged as part of the bankruptcy.
I called Ford Credit and spoke to a rep there. She mentioned that there are 2 separate groups internally. One handles normal loans, one for bankruptcies. As soon as our car loan was listed in the bankruptcy it was moved to the other group internally and reported as discharged. She mentioned that since the loan was not reaffirmed, it cannot be reported as paid even though we paid it in full. Had it been reaffirmed and moved back to the normal account handlers it would have been reported as paid in full.
I called Kevin Hogan and he mentioned that reaffirmation was not really a choice for persons filing bankruptcy back in 2005 because all it meant was that if you failed to make the payments Ford could sue us for the remaining cost of the vehicle _and_ repossess it.
So now I'm stuck. My credit report shows I failed to pay for a car I paid in full. Ford will not report it paid in full even though it was. Kevin Hogan can no longer file for reaffirmation because the loan was paid in full last year.
Although Hogan should have presented it as an option, I can't sue him because it really won't help the situation at all. I can sue Ford, but that will take a HUGE amount of time and expense.
Experian will not mark the account as paid in full because they say the information is accurate.intentially misleading and incomplete but accurate.
