Stole my house without any notice!

On May 28 I spoke with Priscilla, a Foreclosure Representative at Citi Residential Lending. I explained my situation and asked her what I could do in order to prevent foreclosure. She said that she would need to order the numbers and said she could offer a Loan Modification in which all past due payments would be put to the back of the loan and a lower interest rate would be applied thus reducing my house payment and that with my new payment it would be required that the house payment be combined with my real estate taxes and insurance payments.

She gave me the address to download the application and said that I would need to submit the application and all supporting documentation via fax to (949) 862-8769. I did so, at 18:49 EST on May 28, and received confirmation of successful transmission, enclosed please find a copy of the application, supporting documentation and the confirmation. She said that she would be forwarding her request and that next an Underwriter would be assigned.

She said that the Underwriters tend to be hard to get a hold of and that although you may not hear from us for awhile, we are working diligently on your loan and that I should expect the process to take four to six weeks to complete. She said that if the Underwriters required anything further that they would contact me. Before concluding the call I made sure to update all of my contact information and verified again everything that was explained to me.

On June 21 I arrived home, at 16:48 EST, to find a business card left in my door from Joyce L. Royal at Joyce Royal Real Estate with a note written on the card reading Please call me! I need to talk to you. Jlr. Thinking that maybe Citi needed an appraisal done, at 16:49 EST, I called her back at the number provided, (518) 725-5490. Joyce was not available so I left a message with her office.

4At 17:07 EST Joyce called me back, from telephone number (518) 775-1257, and stated that she had been hired by National Default Servicing in California to handle your eviction. She said that if I were to hand over the keys and have everything out by the end of the month that they would give me $1,000.00. I was in complete shock! I told her that this matter was already being taken care of by Citi Residential and she said well the property has already been sold at auction.

I was told by Priscilla that all foreclosure action had ceased and that I was going to be receiving a Loan Modification. Now my home has been sold, without any kind of notice? That is utterly illegal! How in the world can they do that when their representative stated in a recorded telephone conversation that all actions had ceased and that I was going to receive a modification?

Please help!!!
