I had a personal loan with World Finance in Winder, Georgia I quit paying my monthly payment because I decided I needed to file for bankruptcy. After my first missed payment the loan company started calling me on my cell phone at first, at that time I had told them I was filing for bankruptcy and I told them that they would be hearing from my attorney. The Manager-Keith Cheek then told me that it doesnt matter he can still contact me until I have a case number, I said it will be a waste of time but whatever.
A couple of days passed and I started getting calls from my family telling me that a guy from a loan company was calling them to try to get in touch with me and he was telling them that I owed him money.
I contacted Keith and asked him why he was contacting my references when he had my address, and contact numbers for me. He basically told me that he could do whatever it took to collect the money from me and he said that I wasnt keeping in touch with him, I was like there is nothing to keep in touch with, I have retained an attorney and that he needed to quit contacting me and my references.
Well the following week he started calling my work phone, I asked him to not call me at work because any personal calls are prohibited. He ignored my wishes and continued to call me at work four to five times a day. It go so out of hand that my manager gave me a verbal warning that all personal calls had to stop. So I got onto the Federal Trade Commissions website and looked up my rights. The website stated that if I notify the company in writing that they need to cease all communications with me while Im at work then they must comply. So I typed a letter and faxed it to Keith and also sent a hardcopy certified mail.
After this happened I decided to retain a different attorney because the one I orginially retained was worthless, I turned in all my paperwork to get the case started but the attorney had advised me that until he received the full amount for his services he would not start work on my case, he told me I had thirty days to pay him. I told the attorney about the stalkers at World Finance and asked what could I do and he told me to give them his name and number and he would take care of it.
Well the letter I faxed and mailed to Keith did not good, he still contacted me at work and thats when I gave him the new attorneys information, thats when he got load and rude and called me a liar and then he told me that I needed to come into the office that afternoon and discuss this, I asked him Why? Why do I need to come into the office to tell you the same thing Im telling you now, gas is $4.00 a gallon, its a waste besides you have the information you need and I hung up on him. He immediately turned around and called my work phone back to back to back and I wouldnt pick up.
The very next day I was at work and a lady was there and she wanted to speak with me, she was from World Finance. I was in shock because I work in a very small office and everyone could hear and see what was going on. She told me that she was there to collect payment and to find out what was going on. I told her that I couldnt discuss it right now and asked her to leave, she still pressured me to talk to her and about after ten minutes my boss told me that I needed to wrap it up thats when she said that Keith was going to sue me and take legal action today. She left and sat in her car until I left for lunch and I saw her write down my tag information. Not only was this embarrassing but I am in a bankruptcy, I am supposed to protected from all the harassing calls.
After the lady left and I got back from lunch I get this call from Keith Cheek and he said in a smartass voice So, how is your day going? I was like just friggen wonderful, I told him that I have nothing more to discuss with him and to not contact me at work anymore or I will take legal action and I proceeded to tell him that he has continually violated my rights under the Federal Trade Commission and I had already reported him. He told me Yeah, that will shut us down. And he laughed and after that I hung up on him and I was so worked up that I had a panic attack.
World Finance are like loan sharks, I now come to work everyday scared that Im going to get in trouble because they might call me or show up. If anybody knows what more steps I can take to keep this from happening to another person and to stop the harassment for me I would appreciate it.
