Ordered 100 pieces of cardboard backing plus some other items from Impact images (clearbags.com) shipped 9/27/07 to my Highlend, CA address for which I paid $6754 shipping to Impact Images. Impact Images subcontracted Con-way West to deliver the cardboard backing in an agreement to ship on a paleette and deliver to the doorstep of my UPS store address.
Shipment was instead delivered loose INSIDE the UPS Store and had footprints all over it. The driver was not authorized by the UPS store, nor by me to take the cardboard off the palette. He took it upon himself to deliver the goods into the UPS store itself.
About a week later, I received the first of several escalating bills from Con-way for $37.00 additional shipping. When I called Con-way to complain that I already paid shipping to Impact Images, the "customer service" rep answering the phone rudely told me I must have authorized the driver to take the goods off the palette and was 100% responsible for paying the extra $37 ship charge for that "service"!! She threatened me that Con-way would "RUIN MY CREDIT" if I did not pay the bill! That was October.
Since then, I wrote a letter with a testimonial from the UPS store confirming loose delivery from Con-way and lack of request for authorization to take off a palette that was never seen. The Con-way turned the case over to Amalgamated Financial Group and after adding hefty penalties, Amalgamated turned it over to the law offices of Weinstock & O'Malley, who raised the bill to $97.50 and promptly put a derogatory statement on my credit report. My credit score tumbled by over 100 points to below credit worthy level (from 763 to 659 in one day) right after the derogatory statement showed up on my credit report.
I don't know what to do to resolve this and restore my credit. This is a kind of financial terrorism that Con-way apparently was threatening from the very beginning—trying to extort money from me that was unauthorized in the first place.
