A Representitive from Chase Home Finance LLC sent a video to our home in Tomball, Texas that stated we needed to call one of CHF Loss Mitigation Representitives concerning a Plan that would bring the Mortrgage Account current. My wife and I called about 3 days later and we were asked out right out if we wnated to keep the house. Being on a conference call my wife and I said "YES" my wife went on to say my husband designed it and is the builder and we still hadnt finished the flooring yet.

Keep in mind I have almost finished this California style Mediteranean Stucco Home and I built it for $390,000.00 dollars. The un finished Appraisal by Harris County Appraisal District of Houston Texas valued it at $621,000.00 dollars.

We conveyed this huge amount of equity to the Agent of CHF and also told her that we both work in the oil business now and the 4 payments we were behind could be caught up very quickly.

She then proceeded to gather all our employment information and monthly expenditures to nail down a surplus figure that would be the criteria for qualifying for the opportunty to emerge from a Pre foreclosure status.

The agent for Chase then agreed we qualify and she needed approximately 50% OF the Arrears and then we could make 3 or 4 more payments and be back on track.

So she sent the Payment plan sheet with attorney fees and the instructions and " CODE " to wire it Western union. So we did and I called her on her private line and gave the western union MTCN Tracking number to let her know we were for real.

Then we waited patiently for her response or her next instruction.
She stalled for a couple of months then she finally answered in person and said she didnt show the payment in her system so she would have to call me back in a couple of days.

Approximately 45 days past again and now she said the figures that were good have to be adjusted. So now instead of being 4 months behind she stalled long enough to extend the Arrears 3 more payments.

I then was served with papers in my front yard that said my house had been sold and me and my family had to get out in 10 days. This was july 16th. I filed the first suit in Probate Court then in the Harris County District Courts. Well since Chase Home Finance LLC has no place of business in texas their attorneys asked the state district judge to remand the Case to federal court because of a law called diversity which means they feel they wouldnt get a fair trial.

So I asked the federal courts to dismiss it without predjidice and they did.
This is a good thing because they have found a strategy that has worked for them here in texas and all the other past litigation cases in texas were dismissed by the plaintiffs counsel.

So my team of attorneys filed this Multi Million Dollar Statutory Fraud case in late december but did not include Chase Home Finance LLC because they wanted to establish other people involved that had places of business in the state of Texas first. Once that was established the tactic of trying to rremand the case to federal court because of diversity was defeated.

My team of attorneys found the achilles heel and for the first time in the State of texas the attorneys for Chase Home Finance LLC will have to exdplain their clients fraudulant, misleading and malicious actions.

They will have to explain the borrowers may have been behind but they didnt have a second mortgage and they had over $221,00.00 dollars in equity. I know they are a Multi-Billion dollar company with many faces but I gotta believe shelling out a few million will wilt the egos of the teflon Don attorneys in Dallas that had a racket going for so long in the Lone Star State.
