We refinanced our loan with Countrywide. Then Ocwen bought our loan from them and I got a letter that stated I owed $5000.00 when I made a payment to Countrywide that same month. I am on a arm fixed at 7.5% lock in for two years. When Ocwen bought our loan they raise the interest rate to 8.375% that is not what I signed for, but Ocwen said that when they took over the loan that is what the rates were at.in my agreement that my husband and I signed it was lock in not to change for two years. Then we had a freeze last year in 2007 and it broke a pipe under the garage floor had to get that fix so our garage floor did not sink. So we got alittle behind and our family gave us some money to help us (my husband and I) catch up. While we made these payments to catch up Ocwen sent us a check for $1260.00 in April because our account was caught up they said. Then Ocwen put us on a forebearance notice to split up on of our payments for one year so that added $200.00 extra to our mortgage. So for the last 7 month we have been paying $2677.56 a month and paying it on time and because our two year fix arm is coming up and the goverment had the interest rates lowered my husband and I deciced to refinance to a lower and fix rate so we called different mortgage companies and were getting turned down and the said on our credit report that it was showing 7 late payments and our scores where at mid 500's because of that. So I called Ocwen and asked were are the late payments and they said because we are on a forebearance that they have been charging us $112.00 late fees every month and I said we have not been late. They went on to say that since we agreed on the forebearance that is what they do and then I got very angry because they did not send us any paper work for us to signe and agree to that and they were suppose to sent us form which never came in the mail, so we can see the stipulations of this agreement. Which my husband agreed to paying $200.00 a month extra a month for one year. But now we found out every $200.00 we payed they charged us $112.00 a month and put it on our credit report. Then they sent me a letter stating that it was a verbal agreement. My husband and I were waiting for the paper work to come in the mail so we can read what the stipulation were. I myself would not have agreed with what they told me over the phone 7 month later (when I finally got a hold of some one there at Ocwen). We were lead to believe that the one payment would be payed off in one year I asked the man on the phone how much more do we owe on the $2400.00 dollar payment and he stated $1984.91 I told him my calculations came out to be $1000.00, that we have already payed back $1400.00 that is when he told me that there was the late charges of $112.00 and misc. Charges too. Then I ask him what they were and he told me to hold and came back to tell me that it was the phone call and the paper work that I asked him to send me and the postage etc. That is crap. I have never been charged to talk to my mortgage agent before. So now that our scores are messed up there is no mortgage agents that want to touch us and if something doesn't happen soon ocwen sent us another letter stating that as of April 1 our interest rate will be going to the 10.375% and then we will have to try to sell our home and or if the property does not sale it will have to go into a foreclosure. I refuse to do is a bankrupcy. I hope this goes out to everybody in the United States that is dealing with the same company and circumstances that they are never to do this to anybody else in the world.
