My parents just received a bill from Afni, addressed to me. I am a college student and have always been under my parents cell phone plan with a different company. Afni is stating that I owe 463.17 for a Cingular account, but if I pay 231.59 my account will be closed with them. They don't answer the phone when you call the number listed. But I read if you do talk to them they are rude and demand your SSN, copy of your drivers license etc..
In the letter it says "We are making another attempt to contact you", they have never contacted me before this and for that matter I have never received a bill of any kind from Cingular because I have never in my life had a cell phone plan of my own. Can they really contact the Credit Bureaus? They even spelled my name wrong in the letter and I doubt they have my SSN.
I am sending them a certified letter stating:
To whom it may concern:
I'm writing to continue the dispute of the validity of this debt and demand that you cease and desist collection action. You may not contact me by phone.
I am requesting (and under the FDCPA you are required to send) the debt validation, the signed contract that created this bill, and the full account history and itemization of charges. I also need proof that you are legally entitled to collect on the alleged debt and licensed in my state to do debt collections. Furthermore, if you own the debt, I need to see the purchase contract, proof of payment, and full chain of title. Lastly, I would like to see proof that this alleged debt is not out of statute.
If you cannot provide the above requested information within 30 days of your receipt of this letter, I will contact the Illinois Better Business Bureau, the Illinois State Attorney General, the Wisconsin State Attorney General, the FTC, and the FBI regarding this matter.
