In 2003 we recieved a phone call from GMAC mortgage that we were behind on our Ecsrow, so we sent them a check to balance out the escrow, thats when the fight began, they said they never recieved it and we had proof that the check cleared, so after months of trying to get this problem rectified, I was watching TV with the family one SUNDAY afternoon and recieved a call from a bill collector saying that we owed GMAC a payment of $6,000.00, and they stated that if we pay it over the phone we would then only have to pay $4,500.00, good common sense told me something wasnt right here, so I basicly told them where they could put the $6000.00 bill.
We continued to fight them on this issue thinking we could get it resolved, but to no prevail, we ended filling chapter 13 to get them off our backs. My wife and I thought finally we were protected by the laws of the chapter 13. Last week we get a call from our chapter 13 attorney that GMAC is trying to get our case dropped so they can come after us for being late 2 months in a row, I guess they werent smart enough to see we have been paying electronically since and have records of every payment.
We are waiting to here from our attorney on what is going to happen but I am already contacting our local news station and my state represenative, companies like this need to be stopped. They are hurting no one but our working middle class that go to work everyday and try to make a life for them and there families, and I guess I am upset about this whole mess because I cant believe companies are getting away with screwing people over like this in the age of e-mail and internet, sounds like a class action lawsuit to me, I challenge any attorney that may read this to stand up and fight this outrage...
