I was informed on Sept 18th by a customer service representative that the payment made for July was not accepted / returned, It was supposedly returned over a month later. I made this payment on August 11th via western union speed pay as per thier website and my bank account was debited in the amount of $1,338.12 on August 14th. While speaking to this customer service rep I informed her that MY bank account did not show any returns of payment and that the payment was indeed taken from my account.
After speaking to the representative, I promptly faxed over copies of my last 2 months bank statements to EMC's research department. I even spoke with my bank prior to sending EMC my bank statements to ensure that nothing had been returned to my account in the past 2 months. I also have letters from my Bank that say no transaction to EMC had been returned only debited as of Sept 24th.
When I called for an update on the status of the "research" on Sept 24th I was informed that it could take 30 days or longer for a resolution. This is unreasonable to me because now this vanishing payment is going to start affecting my credit score in a negative way. EMC HAS my money and they are treating this situation very poorly in my opinion. I have called them numerous times, sent letters, faxed, emailed EVERYTHING and now I am faced with negative credit reporting because of their pirate techniques. I doubt I will ever be able to refinance now because of this issue and that seems to be the goal they have in mind when it comes to all these dissapearing payments I keep reading about.
If this matter is not resolved within a reasonable amount of time I have the right under the fair credit laws to take appropriate legal action. I will also turn this matter over to the BBB the Texas Attorney General and any other company that will hear my story. If I do not hear anything back by October 1st 2007 I will be utilizing the resources available to me to push this further. I cannot believe that I have TONS of the proof that they need to show they got their money for the month of July and it is going to be this much of a hassle.
