I have been going around with Wells Fargo Home mortgage for two years now. There was a payment that we made that was not applied when we signed up for bill pay through wells in June of 05. We received a notice from Wells Fargo that the payment would be automatically deducted on June 10. Our bank statement reflected the deduction. Collections dept. Called to say we were behind on our mortgage. We wrote to Customer Service, sending a RESPA letter according to the procedures described on the back of our statement disputing the amount owed and the missed payment. We also requested a statement of our account history so we could try and reconcile our records. Wells Fargo completely ignored us. We continued to make the payments for July and August but they were returned to us stating the amount was insufficient. We received conflicting information from Wells Fargo customer service. On August 4th 05, we received a notice that our loan was in default and foreclosure procedures had been initiated. They were requesting nearly $10,000. It was stated that our home would be sold on the court house steps on Sept. 4. That was just the beginning. I have provided all documentation showing the payment withdrawn from my bank account and everything else requested. My house has gone up for foreclosure three times. I have paid over $30,000 most of which has been applied to corporate account or suspense accounts. We tried to refinance two years ago because we had an adjustable rate even though we thought it was a 30 year fixed. We notified Wells Fargo of the discrepancy and that is when the trouble started. We had refinanced with a mortgage broker (Castle Point Mortgage) and Wells Fargo bought the loan. We were advised that we were getting a step down loan that would start out at 7% and reduce by point for three years. A counselor came to our home with a lot of documents. We went through and initialed and were told we would receive our copies by carrier. It took four months for us to receive a document.By that time we foolishly did not review them carefully. We have been given conflicting information from many different Wells Fargo employees all of which we have documented. We have over two crates of documents sent between us and wells fargo. The financial and personal effect this has had on our lives is devastating. We would like to seek legal counsel to sue Wells Fargo for all damages but cannot afford to do so and after all, it is Wells Fargo. I received an updated escrow statement from wells on 4/13. It looked as though our account had been corrected and shown as current and all additional payments and fees credited. It showed a surplus for our escrow and stated that we would be mailed a check. We then proceeded to apply to refinance and get out of this situation and get a loan to repair our home in order to sell and our credit had been updated not to reflect current status with wells fargo and all neg info erased but to show that foreclosure proceedings had once again been started on our home. This is typical of the past two years - continuous conflicting information about our loan. The only correspondence that we have received from wells fargo since 9 was the updated escrow form and an interest increase notice. On Aug. 24th I received a letter from Wells Fargo's Lawyer stating our home was in default and we owed $53,000!!! Due before Sept. 1 or once again the home would go into foreclosure.
