Came home to message on my answering machine that goes EXACTLY like this: "This is a message for C R, by continuing to listen you are acknowledging that you are CR (then a 3 second pause). This is Bryan Ainger, a debt collector with asset acceptance, please contact me about a personal business matter at 1-888-255 ext 3662. Again, this message if for CR, I'm Bryan Ainger a debt collector with asset acceptance. Please contact me about a personal business matter at 1-888-255 ext. 3662." Wednesday, June 27.
Upon immediate review of my credit report I found that the date of last activity on this account was 01. This call came on 6. Statute of Limitations has run its course on this account as I am in the state of Indiana. According to my research, SOL runs out after 6 years in Indiana.
I have a few questions if anyone cares to comment or can help.
1. Does a pause on an answering machine constitute acknowledgment to the debt?
2. Has the SOL ran out on this account due to last activity being 1?
3. Can I still be sued for this debt if the SOL has expired?
4. What should I do to be sure this j*s isn't going to seek a judgment against me and restart this entire grueling process again?
Please advise.
