Took me to court and lost

In I received an unsolicitated credit card from Aspire. It stated I had $1700.00 credit limit, with no activation fee. I used it a few times in one day to buy some things for my son who was moving out of state. I went to the gas station, and realized I didn't have any cash on me, so I charged it on my card. It was declined. I had not spent more than 350 bucks.

I went home and called Aspire, and they told me I had only a 300 dollar limit. I told them I had the paper right in front of me showing 1700 limit. I then told them to cancel my card, and I would send in the balance immediately.

Well, they sent me a statement for over-limit, and no payment. I checked with the bank, and it had no record of that check. I had mailed it certified, and received the receipt, so I know they got it. This went on for a few years, harassing phone calls day and night, sometimes 14 times in one day. I was even called a C&! By one of the reps.

I filed a complaint with the FCC, and notified them in writing that they were not to contact me by phone EVER, only postal mail. Everytime I sent a payment, they either claimed to never receive it or posted it AFTER it was due. I told them they would not receive another cent from me until they sent me an itemized, detailed written report of all activity on my account. Never got it.

2 years went by without hearing from them, then BAM, got hit by lawsuit from MIDLAND FINANCIAL. I showed up in court with all my documents, including copies of complaints by Ripoff writers. The lawyer continued the case, but tried to coerce me into signing the court papers that I agreed to the debt! And, he had it checked that I did not show up in court.

I had the Judge's secretary correct the paperwork. Came back for my second courtdate, and demanded a trial. Showed up for my trial and the lawyer did not show up. The judge dismissed it but with the option that they could come back at me another time. Not sure if they will, but I think statue of limitations is nearing.

To all those experiencing problems with Aspire, document, document, document. Make sure you have the original paper the card came on, and only send papers and payments by certified mail. You must request in writing that they do not contact you by phone, but also state that they may continue to contact you by mail so they can't claim they couldn't contact you.

If you get sued, make sure you show up in court, as they are counting on you not to. I found a great website to also file a complaint and have an attorney look it over. Hope this helps everyone.
