I got a hard money loan in oct to get me out of forclosure. MY back was against the wall because my husband needed surgery and we fell behind on the mortgage. So we were desperate to save our home and our credit wasnt all that good so ej&b said dont worry about it we can help you save your home.
They said how there loan works they go on title with me and my husband only to secure there loan and we have a year to pay them off but in 3 months after we receive our loan what they do is refinance us to pay them off and that would lower are payment.
Well at that time that sounded really good i trusted them but it didnt happen like that. When feb came i called ann up at ej&b and said we were ready to refinance so we can pay them off but they claimed that it wasnt a good time and that we would have to wait.
Well right there i felt something is wrong so i went to another lender in march at loan quest funding the lenders name was william. He said there should be know problem so he pulled our title report and it showed only ej&b properties was on our title not me and my husband. It showed we were no longer the owners of our home.
So i was like in shock because we never sold our home to them we been in our home for 6 years. We recieved a 57.200.00 loan from ej&b to save our home we had to pay around 19.000 to take us out of forclosure and we only received cash out of about 19.000 also. Ej&b got the rest of the money that was around 17.000.
Our payment went from 1600 to 2200 a month and we were told to pay them the full 2200 a month and they will pay our first mortgage at citibank. They said the reason for that is if we run into trouble with the payment. They will pay it for us and just add it on to what we owe them.
Well in april my husband got sick and needed another operation so i called ej&b and explained to them the situation that its going to be hard to make that high payment at this time they reassured me and told me dont worry about it they are there to help us which they did. But the whole time they were paying our first mortgage it wasnt to help us it was to there advantage.
Once again i trusted them but i should of known better. So in may i went from one lender to another desperate trying to get a loan to pay them off but every time they sent ej&b a final demand payoff ej&b hired the payoff which it made it impossible for me to qualify for a loan.
So i been through 5 lenders from april to august and i still want to pay them off but i cant find nobody to give me a loan. Then i come to find out recently that my credit was pulled 86 times from jan up till now i never gave anybody approval to pull my credit except for a few lenders. And that made it worse for us so we put a fraud alert on our credit.
So finally in august ej&b gave us one of there lenders to give us a loan to pay them off. That lenders name is lisa and she promised us a loan and every time we were to sign final docs she called up with a problem at the last minute till finally after 3 months with her she says that there is nothing she could do for us.
The next thing i get is a 3 day notice to move from ej&b stating that they are evicting us do to unpaid rent. We never sold are home to them and now they are taking us to court claiming that we sold our home to them. I would of never agreed to the loan if that was the case i would of let my house be forclosed on. They some how switched the paperwork for us to sign. Because we never would of sold our home to them.
My credit is wrecked they are taking us to court claiming that they are the owners of our house and they want us out. I filed my answer on time so any day we should be going to court. Basically they made it to where nobody can give us a loan. So now i am trying to get help.
So if there is someone out there who can help me please let me know this is a nightmare. I am not giving my house up without a fight.in closing if the house wasnt mine then how can i claim my taxes on it. I filed taxes in jan and got a refund also my first mortgage does not know about my second loan. The statement comes to my house in our name not theres. I have proof of every thing i am saying.
