Fairbanks Capital, ripoff, liars, disrespectful, cheats consumers out of money

Back in 2001 my house was refinanced through Olympus. Then a year later it was sold to Fairbanks Capital and now to Select Portfolio for the last three years.

Because of other reasons I was forced to file Chpt 13 and it took this company almost a year to get their paperwork right. They kept calling and harrassing me, when finally it all stopped. My Chpt 13 was completed in Nov and at the end of Nov I got a letter stating they were asking the Bankruptcy court for a stay against my case because they claimed I owed them for Sept Dec. Now mind you Dec had not come up yet. I had to get my Bkrptcy atty to handle most of this but ended up having to send them over $3,000 dollars in January. This brought everything to zereo totals.

In August they tried to tell me that I was two months behind when I knew that I wasnt because my checks had cleared the bank. I had to pay to get copies of these cancelled checks and had to write to the office in Jacksonsville, Florida fighting this information. It took them over 90 days to get an answer to me as to whether or not I was in default or was it there mistake. After research (finally, since most of you know they dont do the proper researching), it was found that the error was in there offices and they had to credit those two months to my account. However now mind you, in the meantime they were reporting to all three credit agencies and reporting me over 60-90 days past due. During my bankruptcy they were charging me up to $57.00 in late fees each month even though my payment was on time, it was the money from the court trustee who was late. Why is that my fault. When I asked for this information to be corrected I was told there wasnt a thing they could do because I was slack enough to file bankruptcy I had to suffer whatever was reported.

I have gotten to the point now I dont allow them to record my conversations because when you tell them that, you really see how these "customer service reps" really are. Nasty, rude, and belligerent. I have had nothing but problems from this company. THey called me last month and the gentleman on the other end from SPS stated that if I wasnt lazy, I needed to find a job and pay my bills, I stated to him that was none of his business and he didnt know why I was out of work. Then he proceed to wanting to know how I paid my others bills and I stated to him none of his business but if he had to know my husband did. Then he stated that if my husband was a man he'd pay all the bills. Im sorry but this loan doesnt pertain to my husband even though we are married, because this loan originated over 9 years before we got married. He is nowhere listed on this account. Although SPS seems to think that they can discuss my account with him when they call. And after numerous of times him telling them its in my name and they need to speak to me they dont take heed. Well they discussed my personal information with him regardless. This evades my privacy act doesnt it?

Now they have gotten to where they call me over 5 to 10 times a day from an unknown number and when u answer you get the msg of "please hold for an important message" and then it goes busy. If you try to call back you continue to get a busy signal or call cant be completed. If they do reach you when they call from the unknown number they hang up on you as soon as you do say hello. And the excuse they give is, "well that is the automated number system calling you" we cant control that. BS is what I say. Rudeness, lies, cheats and etc... Do not get ur payment any faster.

I want to know what can be done about this company and will something be done about this company. They have to be stopped. When you pull your credit report most of the time the mortgage shows up as SPS but a Fannie Mae account... WHY IS THAT? No one seems to answer the questions and concerns that we consumers have towards this company. They have to be stopped soon.

If anyone can be of help please tell me what else needs to be done other then filing reports with BBB and Consumer Affairs in your local states.

Oh by the way. What are these additional fees and charges that we get stuck with that no one can seem to answer other then stating they were there when they bought the acct from Fairbanks. Outrageous late fees and etc. Also.
