Posting of payment - always one day after due date

For quite sometime now, a year or so, I've been being charged late and over the limit fees nearly every month it seems. No matter when I mail my payment in i'ts seems to always be posted the day after the due date. I've sent it in 5-7 days, 7-10 days before due date and it makes no difference it seems. When I first noticed that this was going on quite often, I called and questioned the posting of my payment and was treated very nicely and profesionally. As time went on and this posting problem continued, I started getting static from customer service and was told I had been givin credit for this a number of times in the past and that they were'nt going to be able to assist me in getting credit for late-overlimit fees any longer. Please note that a couple of times I even wondered if I got it mailed in sufficent time to allow delivery by due date, but only a couple of times, but difinitly not near as many times as they have charged me these fees. I finally said to myself, enough is enough so I did this. I waited till 3 days before my due date and went to the post office and paid $12.45 to have my payment overnited and paid extra for tracking and for someone to have to sign for it's delivery. Guess what and you know what I'm about to say! Yes, it was posted the day after my due date??? I could'nt beleive it so I called the tracking phone # the post office gave me and it was received and signed for the day before due date at 11:46 but was still posted the day after due date. No, it wasn't a holiday, saturday or Sunday or received after 2 o'clock or any of that bullcrap they put on you. So I called and talked with a customer service rep. And questioned the posting of my payment only to be told that one of the above circumstances had to and did play a part in the posting of my payment. Thats when I told her what I had done and how it was sent and that I had called the tracking service and verified day and time of delivery and that it was signed for also. Do you know what this lady had the nerve to tell me? Yea you guessed it! I'm sorry sir but we have no control over the postal service and their delivery practices. That was it! I sent off to the postal service and had them send me a copy of the delivery sheet stating day and time of arrival and who signed for delivery of my payment. Then I sat down and wrote a 18 to 20 page dispute letter. I followed to the "T" what they ask you to do when filing a dispute on an account. This info is on the back of your billing statment on how and what to do when filing a dispute. It also states that when an account is under dispute and being reveiwed they will and you will not be charged any fees. Bullcrap, another lie!!! Since I filed this dispute I continue to get my statment with late and overlimit charges, plus a phone call from Capitol One at least every other day asking for payment and threating to turn this over to collections etc. Talking about a nigtmare that keeps getting worse, your hearing one!!! The first time I was called by Capitol One about my acounts, thats right, not 1, not 2 but 4 different accounts I told them that I had filed a dispute and sent it in. I asked if they had record of this in their computer that I had filed a dispute and they said no and said they would have to transfer me to another department that handled this situation. It sounded like she had just hung up the phone and someone else in the same department picked up because she repeated the same bull as the other lady. I did not receive any correspondance, mail or by phone from the so called reveiw board for about 6-8 weeks. Your right again! They sent me a letter and said we have no control over the delivery of the postal service. Thanks, but you owe the bill, and yes, including any and all fee charges and ask that I send in payment to aviod further late and overlimit charges. What I'm I to do? Please, someone advise me! My latest phone conversation with Capitol One took me thru about 4 different people and 4 dffernt departments. The last lady I talked with was very nice, courteous and professional. She said that she would make note of our conversation and told me prior to us talking that the conversation was being recorded which I had no problem with. She said that she would file this dispute back to the managers for further review but she could'nt say or promise what the out come would be. I would like to say thank you to this lady and she should be commended for her courtesy to Cqapitol One customer. This lady is the only person that I have carried on a decent conversation with and for once I felt as though some progress was made. I assured her that I was willing and capable of working this matter out but also said to her I felt like i was getting charged unfair due to bad practice Capitol One has in posting payments. It seems like only a short time ago Capitol One inserted in their statment that they had a suit filed against them for exactly what I have stated in this letter??? RogerGranbury, Texas
