Automatic Activation of credit card, ripoff

I applied for an Orchard Bank card online. When the card arrived, the fees were disclosed with a whopping $89 a year fee and 18.9% interest rate, so I never activated the card.

Next month, I receive a statement with a minimum payment of $8.90. I never activated the card, so I called Orchard Bank and the CS rep told me that the card was activated at the time I applied. I never saw or read anything that stated this.

There was a sticker on the card telling me to call in to activate the card, so why did they bother to put a sticker on the card if it was automatically activated at the time I applied?

I told the CS to close my account and I paid off the fee balance that day. I have also contacted the Attorney General's office for California and Texas. The Attorney Generals' for both states are aware of this problem and warned me that this has become more common with credit card companies, that and raising interest rates to rediculously high amounts.
