Insurance ripoff for replacement of totaled vehicle due to their insured drivers negligence

On the afternoon of May 18th my wife was sitting at a red light traffic signal on 71st. And Guion Rd in a suburb of Indianapolis when an insured motorist that I will keep unnamed rear ended her. The police report filed showed that he failed to stop for the red light and in doing so hit my wifes 2004 Kia Spectra EX that was deemed totalled by ANPAC. On May 24th an offer was made to my wife in the amount of 10300 plus 618 dollars for taxs. Note that Kelley Blue Book value on the car was 11,300 dollars and our Kia was well under normal mileage for a 2004. The car was in excellent condition and I have pictures to prove that. Upon doing research I found that you could not replace a 2004 Kia Spectra with anywhere near the mileage we had on ours for less than 13,500 dollars.

On June 2nd I had no choice but to except an offer of 10850 plus 651 dollars for taxes. ANPAC would no longer pay for a rental car and Icould not afford an attorney and I needed the wrecked car to be removed off my property due to many complaints from neighbors and the home owners association.

My point is that ANPAC ripped us off. The point of paying for insurance is so that when something unfortunate happens I should be able to replace what I currently had. The money they gave us doesn't even make it possible for me to do that. I also forgot to mention that we purchased that Kia brand new in 2004. All I was asking for was for the money to replace the Kia I had in my possession at the time of the accident. ANPAC would not do that and because we are young and doing well, we don't have the time or the money to invest in getting a lawyer, taking time off of work, ect.

Still today looking on numerous car sales websites you can not replace a 2004 Kia Spectra EX with 27,000 miles on it for that price. If I wanted to replace it with something that had double the miles on it, yes I could do that with some really good negotiating. I have filed a complaint with the IDOI (Indiana Dept of Insurance) and received a letter that they received from ANPAC. Basically telling us our car was in fair condition and "market value" on the car is 9545 dollars which is a flat out lie. I asked them to find me that on the market and they couldn't do it. Now they can, I do not buy it.

I want everyone to know that insurace is a license to steal and until people do something about it, these companies are going to continue to get away with it.
