On October 31 I was sideswiped by a woman driving a van. Unfortunately her Insurance crrier was Bristol West Insurane Group. The woman was polite and appologized saying that her papers were falling in her front seat and she wasn't watching what she was doing.
I am a single mother working 40 hours a week and attending college full-time. I was not insured at the time trying to get my good student paperwork filled out so that I would be paying less for my insurance.
It took a month for anyone to contact me after the initial claim was made and the estimates were made on damages to the vehicles. Korin Tanksley was my correspondence with Bristol West. She called and did a recorded interview about what happened the day of the wreck. After the interview she told me I would be contacted in a few days about the decision.
After 2 weeks of calling and leaving messages everyday. I got pissed because if my vehicle had been totaled I would not have had a vehicle for 6 weeks now.
I did some research on the internet and found out that the CEO, etc. Makes in excess of 700,000 dollars a year not including bonuses. Then I got really pissed because they were holding out for a measly $1300 bucks for my car.
I figured out the email addresses for the company chairmen and began emailing. It took only 30 minutes for Korin to return my call. She then was ready to settle with me saying that I was half at fault and would get half of my damages and have to pay half of the woman's damages. HOW CAN I BE AT FAULT IF THIS WOMAN WAS NOT WATCHING AND SIDESWIPED ME?
I told her I would not accept that.
The next day I get another call from Korin; I AM NOW 100% AT FAULT!!!
How can I go from 50% to 100% fault in only a day.
I get home and have a message on my recording from earlier in the day (when I found out that I was put at fault) and Korin leaves a message telling me to give her a call that I have an opportunity. HOW CAN THEY JUST CHANGE THEIR MIND AT THEIR DISCRETION?
Once they found out that I did not have an insurance carrier that was going to fight for me and that I was a single mother with no money that was there out.
They changed their decision based on their probability of getting away with it!
Now, after sending me a letter telling me their final decision and that they already paid their insured then they have bill collectors calling me to collect close to TWICE the amount they quoted me of the woman's damages when I was to pay 50% of damages. Her damages went form $863 to $1350.
Now they are not only screwing my driving record up saying the wreck was my fault (by the way my record is perfect) they are now screwing up my credit, because I don't have that kind of money to pay.
I have tried to contact lawyers, but they all tell me there is no money in it.
I'M NOT WORRIED ABOUT THE MONEY! THESE PEOPLE CAN'T GET AWAY WITH TREATING PEOPLE LIKE THIS. It needs to be known what they did and how they are out right lying so they can pay their top employees outrageous amounts of money.
