My husband and I are running a small business in Seattle, Washington.
We needed a wireless credit card terminal for our business. Since we were just starting the business we didn't want to sign a 48 Month long lease, just in case the business didn't do well.
So we saw the ad for Verus Financial Services, and called and talked to the sales representative, whose name is George Huyke.
My husband told him that the only reason we are interested in that company is because they offer a month to month lease.
When he faxed us the paperwork, we saw that it was written NON-CANCELLABLE on top of the contract. I called him back and told him that I can't sign this contract because it says it is not cancelable.
He told me that it is the old papers, and I can check the latest agreement on their website, and told me to check the Article Number 26 on the agreement. When I opened the web page I saw that he was right, and Article #26 said it can be cancelable any time.
Just to be on the safe side, I crossed the word NON-CANCELLABLE on top of the agreement and wrote "CANCELLABLE AS PER ARTICLE 26 OF CONTRACT", and printed the 2 pages that article was on, and faxed the agreement to him.
After a short time we received our equipment and started processing. But they never sent us the final version of our contract.
About 10 months later we decided to cancel our service. When I called Verus, they told me that they are going to cancel my subscription, but I have to contact CIT Lease Finance Group to cancel the Lease for the Equipment.
I didn't even know that I had a separate agreement with another company! But that was only the beginning of our troubles! When we contacted CIT, they said that the contract is not cancelable!
I asked them why they finalized a contract that said "CANCELLABLE AS PER ARTICLE 26 OF CONTRACT" if in fact it was non-cancelable! They told me that there isn't an article 26 in their contract!
So I asked them why didn't they call me and say "Excuse me, there is something wrong going on here, our contract is not cancelable and we don't have an article 26", but instead went ahead and finalized my contract! I said if you approved it, it means it can be cancelable!
The response was funny. They said I can't alter the agreement! So I told the case to my attorney, and when my attorney asked for the finalized version of my contract, I called CIT and requested it since they never sent it to me!
All this started in August, yet they never sent me the finalized version of my contract although I called and asked for it 3 or 4 times!
Since I filed a complaint with BBB about that company, they responded to the complaint, and luckily BBB put their response in PDF format and e-mailed to me. It was the first time I managed to see the final version of my contract, and then I understood why they refuse to send me a copy of my contract: BECAUSE IT WAS CHANGED!
Since September I paid a lot of money to my attorney, had to close my bank account so that they won't keep withdrawing money from me by changing the amount, and worse although I told them many times not to call me but contact my attorney, I still keep receiving phone calls from CIT, and they use sentences like " If you don't want to ruin your credit pay it off" and similar threats.
I read other complaints about CIT Lease Finance Group and read a lot of similar things that had been done to other people too that is done to us, and still going on. Some of those I don't even mention because other people already did.
We are ready to take and support all type of legal actions against these companies so that they won't victimize other people too.
Nobody or no company has the right to threaten or bully people especially when they change official documents!
I think these Mafia techniques should not be used by legal companies!
