Ripoff Holding my money

My wife and I closed escrow on a refinance on June 3rd. The primary lender was HomeEq Servicing. Due to a mistake at title, HomeEq was overpaid by over $7,200. We weren't worried however because it was understood that the money would be refunded after 2-3 weeks.

When the money did not come we started making phone calls. After the first week of July had passed, we called and they told us that the check was on it's way. After 3 days and no check we called again and they said it had been mailed but returned back to them. This didn't make sense because we had always received our bill every month. They told us that the check had been re-issued and mailed on the 12th of July. It is now the 20th and I still don't have my check. I live in Arizona and this company is in California. There is no reason for it to take this long. After reading some of these other complaints, I am now worried that I won't get it. 47 days, still no check.
