This company bought my mortgage note from Decision One Mortgage and proptly lost the first payment. I sent a copy of both the front and back of the first two checks they received, along with a copy of the portion of my bank statement showing they were cashed on the same day. They "investigated" the matter and decided it was one payment for the amount of one mortgage payment. The did this even though the bank statement showed double that amount being paid to them. It took me 4 months to get this straightened out. They finally found and posted the payment 4 months late and did not adjust the late payments or interest on the loan.
I lost my job in 2002 and had to file bankruptcy in 2003. The balance owed on this mortgage was included. Now the last 6 months this company has harrassed me every month. I finally gained access to the web site and found they haven't posted another payment for August. They refuse to investigate this. When I call and talk to someone, they state my loan is current, yet I continue to receive foreclosure notices every month.
They also state that my contract reads that they may hire a lawyer on my account and not notify me but may still charge me. I've reread the loan agreement and cannot find that in it. They're charging me $295 for a lawyer they state they hired December. They state it was probably for the bankruptcy which was filed January. They waited almost a year to hire a lawyer? That doesn't make sense to me.
In June of this year a tried to make a payment to them. When I call the answering unit always ask for my loan number. When I put it in, this time I was transferred to the Loss Mitigation Department every time. All that does is ask for your name, number and a brief message. I never received a call back despite leaving 6 messages. I fianally got someone in the collections department and got the payment made.
The latest thing they've done is send me a letter stating they're records do not show that I have home owners insurance. They want a copy of my policy. They've also stated that the loan agreement states they can demand a clause stating they be notified 10 days in advance of any termination in my policy. I find no such statement in my loan agreement on this.
I would be very interested in joining any law suit against this company as tI have lost many nights sleep and almost suffered an asthma attack from the stress encountered I've dealing with this company.
I've lived in my home for 15 years and never feared losing it until this company aquired my mortgage.in fact, I'm trying to refinance now just to get away from this predatory finance company.
