Ripoff - stealing insurance company settlement, from a loyal customer and Vietam Vet

My father, was with another mortgage company, who sold his account to EMC. He has never to my knowledge signed any legal paperwork for this EMC mortgage. My father has always been current on his mortgage payments. His residence received hurricane damage during Jeanne. The damage consisted of mainly roof damage and some ceiling water damage in the garage. He then contacted his insurance company, Vanguard Insurance to assess the damage, and file a claim. Vanguard insurance then sent my father a check endorsed to both EMC mortgage and him.

We endorsed the check and over-nighted the check to EMC mortgage on 2/23. I was told the process would take 3-4 days and then they would overnight the check back to us. I explained to them that we had a roofing company coming over to fix the roof sometime in the next week and could not pay them without the insurance money. The next week after not receiving the money, I called and was informed by a representative in the EMC claims department, that they had cashed the check and would not be sending us the check until we filled out a list of forms. These forms included a mortgagee's affidavit which also had to be notarized, the original contractors estimate, the contractors W-9 form, a copy of the contractor's auto insurance, and the insurance adjusters report.

I then sent all of these forms out the next week in the beginning of March, and our contractor Collins Roofing and Associates sent their forms as well, again through overnight mail. I then attempted to follow-up of the status of our money, and was told we would only receive or approximally 4,000$ which we did receive the next week. We paid the roofing company 5000$ of their money leaving a balance of 2,250$ left to pay. EMC then became rude on the phone and told me I should be pleased that they cut a check at all. I informed them that the money was not given to us from their company but from Vanguard insurance. Since that time and over the month of March, we were in contact with the company numerous times, and were informed each time that our paperwork was not in order.

I have copies of everything requested to EMC, and Collins Roofing has informed us that they have sent EMC the needed paperwork twice and faxed it to them as well. It does not appear that EMC will be giving us the rest of our insurance settlement so that we can finish the repairs to our residence or pay our roofing contractor. EMC mortgage has also informed us that we will not be receiving the interest, which the claims money generates.

My father is in VERY poor health and has been admitted to the hospital numerous times over the last 2 months. Currently he is a patient at the Veterans Association hospital in West Palm Beach where he is scheduled for an amputation of his left leg this week. During all of our family's hardship we should not have to deal with a crooked mortgage company, who appears to be unwilling to fulfill their obligations, to their loyal customers.
