Full refund due to violation of the federal trade comission act

Please refund the full amount of $544.00 for the vacation package that I purchased from the Ramada Plaza Resorts based on the fact that the advertisment was false and deceptive.

My information is:

Ramada Plaza Resorts has intentionally violated Florida's Federal Trade Commission Act by engaging in unlawful methods of competition, unfair and deceptive trade practices, including, but not limited to, travel scams, and false and misleading advertising.

Ramada Plaza Resorts OFV/IM, LLC is also in violation of the U.S. Postal Service Mail Fraud Laws since you sent your false and misleading advertising via the U.S. Mail.

If a full refund is not received within 15 days of receipt of this letter, I will begin legal proceedings that include a class action lawsuit in the State of New York.

I purchased this package because I received a letter in the mail from Ramada Plaza Resorts saying I was credited $1600.00 to a Spectacular Florida/Tropical Caribbean Cruise vacation package. Since this paper stated it was from the Ramada, a trusted name, I decided to call the number given. A company representative then falsely mislead to beleive that if I payed $600 dollars in advance I would be put in first class accomodations throughout my whole trip. I have since learned that my exclusive award-winning accommodations include two second-rate hotels and an old, inadequately kept ship. I then checked the internet to find out more about the Ramada Plaza Resorts and i came up with a list of dissatisfied customers and governmental warnings and litigation.

The package I received in the mail had pictures of the two hotels and the boat and it all looked very nice. Since I live in Buffalo, I was unable to checkout the hotel myself, so I contacted a friend who lives in Ft. Lauderdale Florida to go look at the hotel for me. Unsurprisingly everything negative mentioned about the trip turned out to be true and my friend said the hotel looked nothing like the one in the picture but more like a 70's style motel.

In the package they sent me, a cancellation notice was included that stated "You may cancel this transaction without any penalty or obligation, within three business days from the receipt of this disclosure." I sent them the cancellation notice and a week later I called them to see if they had received it.

I contacted Ramada Plaza Resorts on February 14 and asked them about my cancellation notice and a representative I spoke with said that they never received one, even though they had signed off on receiving it! I then spoke with a man named Gerson and I told him that I wanted to cancel my trip. He told me I could not cancel it but he could give me till 2007 to use my trip. I told him I did not want to go on the trip at all and I wanted a refund. He was rude to me but after lots of complaining on my part he unwillingly said he could refund me for $170 but that was the most he could do. $170 is not even half of the $544 that they dishonestly took from me.

Since you, your co-conspirators, and your company are no strangers to lawsuits, you know very well that it will be worth your effort to see that my refund is sent to me promptly. I have no intention of going away or letting this end until I have been fully compensated. I may be reached by U.S. Mail ONLY. All correspondence must be in writing.
