We went to a home and garden expo in January when we were enticed by a fast talking sales person to attend an overview of a new resort development "Cibola Vista" and receive a vacation package to San Diego or airline tickets anywhere in the country including Hawaii and Puerto Rico. We figured we don't really have time but we are newly weds and we could use a vacation honeymoon to San Diego or Hawaii. We attended this "overview" in February when all the brain washing started to happen. "think how much money you spend on vacations... This is a five star resort... You can go to any five star resort..." It sounded too good to be true, but what do we know?

The claim of the salesperson and the sales manager was that this is the hottest property in Arizona. It has red weeks all the time, you can exchange your weeks at anytime..."we are so confident in our property that we will BUY it back from you whenever you decide that you don't want it anymore, but once you experience it you will realize that this was the best INVESTMENT ever.
They proceeded to tell us that the property will not be completed until October and any deposits paid will be placed in escrow until completion of the project and payments don't have to be made until then. And on top of all this you will receive unlimited "weekend getaways" for $99 if we wanted to go to the beach or the mountains for the weekend as well as discounted airline tickets better then any rate out there plus day use of the property.

We thought long and hard... We cant really afford this right now, but we don't have to pay anything until October when the project was completed and at that time if we decide against it they will buy it back, so our deposit right now is basically in a savings account and we don't have to worry about it.

We were scammed...

It is barely two months later and the deposit was taken out of the account and we got our first bill... Numerous phone calls were made but no resolution, we are now told the deed is recorded and we are responsible for the payments... This put a tremendous financial burden on us. We were expecting not to pay anything until October as we were promised, but we have no way out it seems... We figured well since we have this vacation membership and we can get discount "weekend getaways" let's get away for the weekend... It is only $99... We searched high and low for these specials... They don't exist... We can't find a special anywhere... Fine we were misled... You have to reserve 90 days in advance... Who plans a weekend getaway 90 days in advance... And about those discounted tickets, they are higher then the normal price... But not only that, you have to have 60 days advanced reservation with many block out dates and you go stand by... Okay so we

We are very unhappy, we feel taken advantage of... After fighting with the owner of Cibola Vista about buying back the property... He informs us that they don't want to buy the property now because they have excess inventory... What happened to this is so hot we are selling out... He offers us a deed in lieu of foreclosure, forfeiting any deposits and any money owed and any rights to the property if we sign an affidavit saying that Cibola Vista fulfilled their side of the bargain and did nothing wrong and that it was solely our decision not to keep our property. But we don't have to make anymore payments.

Is that fair? We don't feel comfortable signing a statement like that... We were scammed... We were lied to and purposely misled... We couldn't even research the company because we were forced to make a decision on the spot..."that special is only valid on your first visit"... We learned our lesson.
All we are asking is to get our initial deposit and any payments made... Oh... And the ticket to Hawaii... It is only valid in the "CONTINENTAL UNITED STATES" with 60 days advanced reservation and with all the dates that we could fly blacked out.

Maybe we are Naive... But if that isn't a good scam, I don't know what is.
