Bikebuyers.com Or A C Trading Company Decipitive Adversting and Dishonest Vendor Ripoff

Http://www.bikebuyers.com or also know as A C Trading company offer what they concider high quilty bikes at a fantastic price. Being concered with the idea of ordering a bike online I checked our their return policy.

What they tell you on the site:

"We have the most straightforward return policy possible: If you don't like your merchandise for any reason, simply return it within 10 days after the original purchase date."

So when I recieved the bike I had concerns, it looked really cheap the componets where far from named brand by any means and the brakes looked very sketchy for any child to ride. So it took the bike to a reputabul bike store. They not only agreed, confirmed with me the bike was not safe but showed me brand name bike and the true difference in the quality. From there is was a pretty simple decision, I email the company and asked them for an RMA number.

The company then tried to say well... What you bought was a promotional item. And if you read the fine the print, you will see that we don't do refunds on promotional items. I went back to the site and if you look closly you will see a little flying banner that says promotional item. I checked the rest of the bikes on the site, 98 out of 100 where promotional items.

This company had no intent on taking any item back. The return policy is only there to mislead you into believe your are entering into a safe puchase. From there your stuck with a cheap and unsafe bike. When I asked the company to return the bike you could tell one thing, they have your money and it would take and act of god to pry it out of there greedy little hands.

Here is the bottom line:

The Court in a footnote cited the Lanham Act which states, in section 43 (a), in part:

(B) in commercial advertising or promotion, misrepresents the nature, characteristics, qualities, or geographic origin of his or her or another persons goods, services, or commercial activities, shall be liable in a civil action by any person who believes that he or she is or is likely to be damaged by such act.
15 U.S.C. 1125 (a) (emphasis added).

Thus, the Court, citing another case, stated:
To establish a false or deceptively misleading advertising claim under section 43 (a) of the Lanham Act

(1) a false statement of fact by [Bikeword.com on its site] about its own or anothers product; (2) the statement actually deceived or has the tendency to deceive a substantial segment of its audience; (3) the deception is material, in that it is likely to influence the purchasing decision; (4) the defendant caused its false statement to enter interstate commerce; and (5) the plaintiff has been or is likely to be injured as a result of the false statement. [emphasis supplied]

Don't do business with this site or this company!
