Oct 23,1999 I was at a local car dealership. To purchase a car. The chair that the finance manager pulled out for me to sit in broke. Leaving me with 2 bulging vertebra's.
I hired attorney John J. Hyland, to represent me, in my law suit against Metro Nissan of San Bernardino. About 6 months into the case, during a phone conversation between Mr. Hyland and myself,
I ask Mr. Hyland what my case was worth. Mr. Hyland informed me that I would receive around $350,000.00, Once my case was settled.
Then after almost 2 years of Mr. Hyland representing my best interests. I received a phone call from Mr. Hyland informing me that an offer of $1500.00 had been made.
Mr. Hyland also informed me that he did not recommend that I except said offer. I agreed with Mr. Hyland and turned down the offer of $1500.00.
By the end of the conversation Mr. Hyland said that he would be able to get me a few thousand dollars.
Then stated that my case should be settled by the same time the following week.
When to my surprise, I received papers for a RELEASE OF ALL CLAIMS in the amount of $5000.00.
I was confused, there had to be a mistake. Boy was I wrong, Once I reached Mr. Hyland, I inquired about the Release of all Claims, Mr. Hyland informed me that there was no mistake.
He recommended that I take the offer. I tried to explain that $5000.00 wouldn't even cover my prescriptions, let alone the rest of my bills.
Mr. Hyland then informed me that he new what was best for me. When I still declined the offer, Mr. Hyland then informed me that if I was unwilling to except the offer then he would no longer be able to represent me.
Due to the neglect and just plain laziness of my former attorney, Mr. John J. Hyland. It's been impossible to find another attorney to take the case.
It's been brought to my attention that not only was Mr. Hyland not representing my best interests, he, (Mr. Hyland) was doing damn little in regard to my case.
It seems that Mr. Hyland couldn't even muster enough grace or pride to hide his laziness.
Mr. Hyland did enough on my case to keep it going, He did nothing in the way of discovery.
The only Deposition that was taken was mine. My attorney, Mr. Hyland never interviewed there witnesses nor did even attempt at getting depositions from anyone at the dealership.
He didn't get all of my medical records. When I say all, I mean Mr. Hyland got only the medical records from before my fall at the dealership.
The only medical records that Mr. Hyland took the time to get, where my ER bill and the bill from the M.R.I. And I gave him copies of those two bills.
