This email is a follow-up to a previous Positive Return customer list on this site who had a similar experience that I had. Positive Return typically does not negotiate ANY of your debts. They just take your money and buy new fancy cars with it. They will let you get sued by your creditors and not help you. They are only in this to scam you out of money and will not budge if you try and ask for your money back.
The California Dept. Of Corporations is trying to shut them down right now and it looks like they are succeeding. These guys will use every trick in the book, including threatening WEB SITES LIKE THIS ONE with legal action if the negative information about them is not taken down.
They are professional scam artists and you should run away from this company as soon as possible. At last count the Sacramento BBB has received forty comlaints about Positive Return. Check out the BBB details:
Customer Experience
During the previous three years, the BBB has received fourty complaints. Thirteen were resolved, eight were responded to by the company with an explanation of its position that the circumstances did not warrant the adjustment being sought by the consumer. Nineteen are still in process.
The agreement between the company and its consumers provides for an initial minimum retainer as a percent of the unsecured debt to be settled. The contract states that the retainer in non-refundable after a thirty-day notice of cancellation period.
Customer agreements also provide that the company is to receive fees that are a percentage of the amount by which each debt is reduced.
Customers are expected to make monthly deposits into a custodial account that can be accessed by the company to pay negotiated lump sum settlements to creditors and the company's fees.
Some customers complained that the company had not contacted the creditors, and as a result, the customer's credit continued to deteriorate.in some cases, customers indicated that creditors had taken legal action even though the customer was making their monthly payments to the company.
Other customers complained that they did not receive statements of their accounts and difficulty reaching the company to discuss problems.

Government Actions
It is our understanding that on May 28, the State of California Department of Corporations has issued an Order requiring that the company and specified individuals desist and refrain from engaging in business as a bill payer and prorater unless and until they are licensed or exempt from state laws generally requiring licenses for proraters and bill payers.
