But here is my case
I moved to Wexford Village Worcester MA, in Jan
They offered me 2 options, either 8 month rental for a studio for 1100$ or 1 year rental of 800$ for that studio security deposit
Since I am a student, was working on my internship, I chose the least payment of 800$, but in the middle of the year I got to move to CA for the job requirement, and I CANT add more than 1 other tenant, I cant break the lease (unless paying 2 fines totally 3200$)!
I found roommates, about 12 potential ones, and they rejected ALL of them for poor credit, other reasons, etc
Finally I found 1 tenant, who qualified who moved in, unfortunately before the end of the year, the
tenant traveled abroad.
I had to find someone to take care of the apt.in MA while I was in the west coast.
At the end of the tenancy period, I was shocked by a bill of 183$ MORE than taking my security deposit of 500$, totalling 683$ damage in the apt. I went through the details, it was nonsense, cleaning fridge = 50$, cleaning oven = 45$, painting the wall, removing trash = 50$ (trash is only 1 old vacuum cleaner and 3 key chains), and replacing the carpet on my own charge without giving me a notice, since I am miles away. The carpet was not dirty, some stains are cleanable - and I have photos.
MA general law states the tear and wear for the carpet - which means the landlord can charge ONLY a PART of the payment when replacing any furniture, UNLESS it was brand new when the tenant moved - and it was already 2 years old before I came in.
Finally, talking to them, I discovered that they were punishing me - saying you allowed someone not on the lease to enter the apt. Or I was subletting illegally. I allowed her only because the apt was FREE for 2 months, in a bad neighborhood namely Worcester MA.
They are always threatening about credit reports and such nonsense, and making use of the fact that I am in the west coast, not taking the security deposit only, rather over charging and never obeying a rule (take, but give a little).
They keep saying - why you didn't break your lease? I answer would you break the lease and pay 3200$ total fines (2 months ahead and 2 months fines?) he answers rudely - yes I would...
My answer is - are you lying to me babe? Anyone breaks the lease for 3200$?? Am I buying or renting to pay 3200$ fine?
Basically I think that only 350-400$ is the real amount, and they added extra 300$ since they realize that I am in CA, and it is worthless to travel 6 hours back and forth to a court in MA.
I believe that they cant take the extra over the security deposit - even when they say it's approved by them, but still I can approve shooting someone on the street the same way they approve that.
