Diane Van Ness illegally preys on families in the lowest depths of their misery, while hiding her actions from the one or two judges she "works with." This alleged guardian ad litem creates, then takes control over, the most troubling quagmires in Miami-Dade County family court.
Specifically, from our experience, she files false reports of child abuse and takes swift, aggressive action in the courtroom with no opposing counsel to represent both sides of the story. She has perjured my medical reports, at my cost, as well as the heavy and tragic cost of the children involved. I have watched children suffer years later from the trauma she caused them, leaving them baffled, confused, addicted, and "allegedly abandoned" for years by parents that did nothing but love them.
She permits few, if any, visits, then lies to the judges that visits are being held "regularly." She claims these children need to be "protected from danger, " which idea rests largely in her own mind. She omits all evidence, records, reports and witnesses that attempt to reveal the facts.
Diane M. Van Ness' website is misleading and eerily simplistic. She no longer practices business law, after being thrown out of that arena many years ago. Sure, she may have jumped on the foreclosure bandwagon during this recession and filed a case or two. That does not a business attorney make. Those who do see her downtown avoid her at all costs, and understandably so, based on our documentation.
While her website claims she represents children in "high conflict cases, " she, in fact, creates high conflict in family cases that need nothing more than a good mediator, family therapist and parenting coordinator. She then stays on these "created" cases of hers for years, rather than weeks or months, and commits what my colleagues and I consider extortion against innocent parents, bringing them to their knees clinging to life, while virtually begging to see their children, and while their children virtually beg to see them as well.
Diane Van Ness is so inappropriate, in our opinion, that she will not even allow supervised visits downtown, on a sliding scale, as most judges allow for.instead, she eeks out "power" by demanding few to no visits between loving parents and children, whom she then extorts money from. I have seen it multiple times.in my opinion, this woman should be disbarred and incarcerated.
It has become concrete and clear to us that Diane M. Van Ness lacks all knowledge of child development, family dynamics and sattelite psychological issues such as trauma, domestic violence and resulting affects on the family members. While other GAL's work tirelessly to bring needed services to these children and families, including counseling, child support both retroactive and current, 12-step program information, and restraining orders against the dads, Diane finds herself, for the first time in her life, having had no family herself, in a position of complete power over what she unilaterally considers "punishment" rather than "wisdom, practical solutions and healing."
I find it disturbing that Diane M. Van Ness considers herself a General Magistrate. One need not wonder which judge appointed her to this position.
Her medical and police omissions are shocking, bank records even more disturbing, and telephonic monetary demands far beyond that which is owed disgustingly unfortunate. All documentation is confidentially available if a class action is filed.
Consider this my/our review for the sake of multiple children of Miami-Dade County. Thank you.
