In June I placed several local phone calls from a motel to another motel we'd stayed at the night before - my wife inadvertantly left her purse at the former motel. The calls were billed to my credit card. These calls were "local long distance" and were only about thirty or forty seconds long. The calls, even though not long distance, were diverted to Legacy Long Distance Internatonal.

For calls which should have cost only $0.07 (seven cents) per minute, we were charged $1.10 per minute with a three minute minimum for each call PLUS a "connection fee" of $7.50 FOR EACH CALL, PLUS an "equipment maintenance fee" of $5.50 FOR EACH CALL! Consequently, we paid $15.96 for calls which otherwise would cost seven cents! The total of the calls was $102.18.

I called Legacy and was told "Those are our rates and are completely legal" and that "if I didn't like the rates, I should have not made the calls". I stated that if I had known the rates, the calls would not have been made. Legacy stated that the cost of the calls were posted near the phone - THEY WERE NOT - Only the instructions for making calls! They said no more and just hung up. I consequently filed a complaint with the Federal Communications Commission.

The FCC communicated with Legacy and, ultimately, Lagacy Agreed to refund 75% of the cost to me, about $76.00. This was stated in a letter to me AND TO THE FCC that was written by Mr. Rafael G. Quinto. While not admitting any wrondoing, Legacy said they'd refund the money to me "as a courtesy". The letter was dated October 01. (it is now Jan. 14).

I called Mr. Ounito at Legacy several times to inquire about this refund or credit, and am told he will investigate and determine when the refund/credit was issued and "get back to me within two hours". This same thing has been told to me three times. They never return the call. The FCC closed the case when it received the letter from Legacy stating I'd be given a 75% refund or credit.

Now, after my contacting the FCC to inform them I never received any credit or refund at all, has reopened the case. (For reference purposes, the FCC's reference number is: IC#03-10054076)
