I bought a toy called Stringin' It 3-D light show from an online store called Star Magic. The return policy says they will make returns within 7 days, and that they will take returns for defective merchandise.
I bought the toy on December 15 for a Christmas gift. The package was not opened until December 25th, Christmas morning. The toy was used for less than 10 minutes and stopped working. I contacted Star Magic immediately by email asking them if they would make an exception to the 7 day return policy as it was not opened immediately due to it being a Christmas gift. They did not reply.
I emailed again the following Monday, and again no reply. I waited a day then I called the store. The man I spoke with, Sam, said the toy was under warranty and I needed to contact the manufacturer.
I contacted the manufacturer and was told the toy was discontinued and they had no replacement and could not repair it and to ask the vendor for a refund. I emailed the vendor again and sent him copy of the email sent to me by the manufacturer. Still no reply.
I called the vendor today and he said he had nothing more to say on the matter. So I paid for a defective toy that can't be replaced under the manufacturer warranty nor can I get a refund from the vendor.
Even if the store has a no-refund policy, New York Law says they have to refund or replace defective merchandise.
