Apex Realtors Rude Customer Service, Untimely Sometimes Nonexistent Property Maintenance, Unethical Billing Practices

I lived in 1 of their homes for 4 years.in that time I was under a lease for the first 2 years then on a month to month for the following 2 years.

During my 4 years at the home I had nothing but problems trying to get Apex Realty to take care of issues at the house in a timely manner. They expect rent to be paid on time but dont give the same courtesy to their tenants for repairs. Right after my 1st year in the house and another repair that had not been made I got Ray Johnson on the phone and he had the nerve to tell me that they were in no hurry to get the issues fixed. I clearly stated my unhappiness and he went on to inform mr that per my lease if I have reported an issue in writing & its not taken care of within 10 days I was within my rights to terminate the lease with no penalty. I was shocked that he would rather have me break my lease and move than to take care of the issues.

Here are just a few examples of the many issues I had with their untimely, sometimes nonexistent maintenance service and rude customer service over the 4 years.

My first month in the house the AC went out and had to be replaced, it took 2 weeks for them to get someone out to the house to look at it and get approval to get it replaced. Yet when it was replaced the heating core part of the unit was out of stock and I was told they would be back in a week to put it in so I could use the heater when winter arrived. To my dismay it took me 5 months to get Apex to send someone back out and put the part in the system. Well after winter had begun.

My hallway flooded (multiple times) Apex had a carpet company come out and remove the padding and they were supposed to send them back as soon as the flooding issue was fixed. It took 4 months and 3 written requests for them to get the carpet padding replaced.

Another time my hallway flooded and they sent a plumber out to repair. The plumber had to cut a large hole in the wall in the kitchen to get to the pie that had to be fixed. The hole was huge. I requested multiple times in writing to have the hole repaired. 15 months later when I moved the giant hole was still there because they never sent anyone to fix it.

I notified Apex about a soap dish that fell off the tiled bathtub/shower during my second month in the house. I also added the issue ot the list of issues each time I sent in a written request for repair (they dont accept phone calls for maintenance issues). 4 years later when I moved it had still not been fixed and they now have mold growing behind the walls and coming through all the grouting in the shower.

The City of Lewisville came to the property in May of 08 and found a leak on the property. I notified Apex and let them know that I would need a letter from them stating that the leak had been fixed to give to the City of Lewisville. Of course my repeated requests were ignore and I never got the letter, instead I got to pay a fine for something that was completely out of my control. Had the city received that letter within 30 days of notice there would have been no fine.

The heating core burned out in the oven 6 months before I moved. It was still not working when I moved which made it impossible to cook during that last 6 months.

They sent repair men out to fix the dishwasher (after months of complaints). The repair man wired something incorrectly and started a fire inside of the dishwasher melting the inside door of the dishwasher. The same repair man continued to try and fix the dishwasher and ended up causing more damage that made the dishwasher flood the kitchen, hallway and dining room. I came home from work to find a note from him stating there had been some minor issues and he would be back the next day to complete the repair and found all of my Good White Towels laying on the floor in the kitchen trying to soak up some of the flooding. The towels were ruined due to the fire residue that came out with the water. When Apex was notified they laughed it off and said, Towels arent that expensive go buy some more and be happy that nothing else had been damaged in the fire/flood.

Those are just a few of the things that happened during my time in that house. I finally reached my breaking point and decided to move. I sent them a certified letter in June 09 (per the original lease stipulations) giving them 30 days notice of my intent to vacate the property. I made it clear why I was moving and itemized the information above in that letter as well as letting them know that I expected them to pull out all of my written notifications regarding issues with the property and to hold non of them against my security deposit since they were not caused by me but by their lack of property maintenance. The certified letter eas signed for by B. Brewer at their address.

Each month since I moved (July, Aug & Sep) I have received a letter from them stating nonpayment of rent for that month as well as claimed late fees for those months as well. I also got 3 calls from Ray Johnson during July asking my why I hadnt paid my full rent in July (I only paid the prorated rate for the time I was there per the 30 day notice). I told him each time that I had moved and that they were notified in writing that I was terminating my least. I also pointed out to him that they very well knew that I had already moved since they have had a "For Rent" sign in front of the house since a week after I moved. Each time he said he would notate the records and forward my deposit back to me as soon as they inspected the property. I got a second letter in Aug. Stating nonpayment of rent for Aug. I left 4 voice mails for Ray but he never returned my calls. I got another letter in the mail in Sep. Stating I had not paid my rent for Sep. When I called I was sent to Ray's voice mail again and never received a call back. I also sent them a fax requesting that the cease sending me letters demanding payment for rent that is not due as well as a copy of the original notice letter and a copy of the signed certified mail receipt showing they got my letter. I requested that they get back with me to let me know they received the fax and I would also like a letter/email stating that my account with them is current and that they would forward my security deposit without haste. I know they received the fax because I have the confirmation but I have not heard back from them.
