Complaint / Review
United Parcel Service
Insurance, fraud, small claims, court

A little over a year ago I was shipped a package that contained a fairly valuable art print. Upon arrival the item was damaged. It had a busted frame, shattered glass, and minor scratches to the print itself. I took the necessary steps to file an insurance claim on the damaged print but have never been reimbursed and I will detail the order of events below:

1.) Item was taken to a UPS store by the seller of the item.
2.) Item was packaged by the UPS store.
3.) Item was shipped and arrived damaged at my residence.
4.) Insurance claim was filed and upon filing, UPS stated that they would need to send a driver by in order to pick up the damaged package. I refused to allow them to pick it up for fear that I would never see the item again (as has happened to me on a previous incident). They stated that I could take digital photos and email them in if I followed the instructions exactly as requested.
5.) I followed the instructions exactly as requested and a week later UPS is sending a follow up email stating that the photos were never sent. I send them again!
6.) After the photos are received, this is the point in which I stop receiving communication from UPS. I request a status of the claim by email, website, and certified email of which I never receive a response to any of the three.
7.) A small claims suit is filed against UPS!
8.) UPS fails to respond to the summons until 88 days after it is filed at which time I receive a defense letter one week prior to the hearing.
9.) UPS has an attorney contact me 7 days prior to the court hearing and offers a settlement for UPS to repair the print.
10.) I refuse the settlement offer!

UPS argues that they were not given the proper 30 days to respond to the summons and instead given 20 days. It took them 88 DAYS! They also argue that they do not fall under the court's jurisdiction since they are a foreign corporation (out of state). The answer is yes they do and if they did not then there was no need to answer the summons in 88 days or ever for that matter! This case has been recessed for "further review", hence the lack of more specific details at the moment... More to come.

They will fight you until you give up, or wear you down hoping that you will go away! Do not buy insurance, never insure anything. It only benefits them. UPS (United Parcel Service) insurance is fraud and a scam, and this story is also available at
