Was not willing to give me deposit back for photos never taken

I paid a retainer/deposit on a photo shoot for my children. I cancelled 2 weeks before date of shoot and Michael refuses to give me a refund.

Cancellation policies were not explained to me nor are they on the website. Photographer did not lose any time or money but yet refuses to comply. He says that money was already spent.

I wish that I had never found this photgrapher and simply want my money back. How could he keep money he didn't even work for? We have no binding contract it was only spoken and e-mailed.
