I went into to a local cell store " cellular source which I had dealt with before, I was inquiring about the new nokia 3650 gsm phone the one with the camera built in, and I had the car kit that would work with that phone so I didnt have to buy additional stuff, during the conversation I explained that I already have a contract with AT&T for another year, and wanted to know what I needed to do if I wanted to buy another or better phone, the salesperson jay, told me that I would have to buy the phone outright and they didn't have that phone in but he explained to me that the Motorola t720 was a good phone and it had a camera attachment I could use with it, and the car kit worked great, better than the one I have for the nokia.
So I guess I got all caught up in the sales pitch and was late for job so I said, OK get me the phone he said leave me $100.00 and he would get the phone for me, also I wanted a phone that could be hooked up to my car as a car phone with out doing a permanent attachment as I lease the car and didn't want to make any holes in it.
So I went to my car to get my pocketbook to write a check, he also said if I gave him a check for cash he would not charge me tax, when I came back he said to write the check out for $525.00 for the phone and the car kit. So I did with out thinking because I had dealt with that company before and then went to work. When I got home from work I went on the Internet to look up the phone I was going to check out all the features and I discovered that AT&T had the phone listing for $249.00 with a $100.00 rebate, now I started to get angry
So I called AT&T and asked if I could get that phone for that price although I already had a contract, they told me yes and was willing to ship it to me right then and there and I was going to be able to keep my same phone #, now, along with this new info, they also told me that the camera was not supported on At& t so now I was really angry, not only was that cell phone place trying to rip me off they also miss informed me about the camera! And the price of the phone!
I called my bank the next morning to see if the check cleared because I was going to put a stop payment on the check but it was already cashed! That was at 9:00 am! I called the cell phone company as soon as they opened and told them that I changed my mind and I wanted my money back, they asked why, so I explain to them that the phone was only $149.
After the rebate, And they were charging me too much, and that the camera that would come with the phone is not supported by AT&T, they flat out told me that I would not be able to get my money back! I did not sign any contracts with them! I have a receipt that has the dollar amount I gave him but with no product info on it, just the dollar amount. When I called then them they informed me that the receipt states that there are no refunds, 7-day exchange or store credit only.
But wouldn't that apply for a product that I already have? I dont have the phone in my possession, and what about my rights to change my mind, it wasnt even 24 hours? After they lied to me about the amount of the phone the car attachment and the camara! Dont I have 72 hours to cancel? I went there yesterday @ 1pm and was on the phone with them at 10 am when they opened the next morning! What rights do I have! I got swindled into an over priced phone that doesn't even have the features that I came in for in the first place! Help!!!
