They clearly misled when they solicited my involvement over the phone.

A girl with very pleasant and engaging manner told me the service was for $295 annually. (They are billing me monthly)

She told me I had 90 days to be satisfied or my money back guaranteed, no questions asked. (They have NO satisfaction guarantee.)

I would receive paperwork in the mail and I would have time to look it over and be completely satisfied. (Nothing came in the mail, which is a violation of St of WA statutes and my attorney sent a letter.)

The description of the services led me to believe that clicksmart.com was a Yahoo company establishing itself as competition to other professional directories such as Dexonline, Servicemagic, etc. (They are not associated with Yahoo at all.)

Capital One's own correspondence to clicksmart.com requested proof of their claim for a charge against my credit card. Capital One asked for a document showing my signature or a voice recording of me agreeing. (All they provided was the fact they had my credit card number. They claimed I agreed and they heard me but no proof provided. Capital One chose to ignore that and allowed the disputed charge to go through again.)

Capital One asked ME to provide proof of my cancellation. I told them that I called them and cancelled as soon as I realized they had misled me about the terms of the agreement. They did NOT grant my cancellation and insisted I had a one-year agreement. Of course I did not agree to a one-year agreement because my company isn't big enough to justify such an outrageous fee. (I can't give you proof of cancellation if they won't cancel. My cancellation happened according to their phone transcripts but Capital One nor clicksmart recognize oral as proof yet clicksmart's Service Agreement claims the terms of the agreement are adhered to based on the oral telelphone agreement.)

Upon reading through their agreement, which is part of Capital One's dispute file, I see that they do not have a cancellation policy. They have no satisfaction guarantee of any sort. Their performance is NOT based on anything I can measure and only on the number of click traffic they receive not what I receive. HOW CAN I CANCEL IF THEY HAVE NO POLICY AND IF THEY REFUSE TO CANCEL WHEN I CALLED?

This is a company doing a scam of professional businesses. Capital One should distance themselves from scams.

Now let me tell you how we know this company is a scam. These are the events as I have recorded and clicksmart has recorded.

1. January - They called and made promises and assured me of what ever they thought would gain my confidence to release my credit card number. (Other contractors I contacted in my area have reported the same technique as I experienced. They were promised satisfaction guaranteed and time to cancel, etc. They were also under the impression it was a Yahoo company.)

2. Ian is the fellow we all talked to. He is very articulate and usually keeps his composure until he is satisfied that he has hit a road block and then he threatens lawsuit and reporting on your credit rating.

3. When I insisted that I was lied to, he said, "I will play the tape for you. If it says what our script is, which is a monthly charge and you are heard agreeing to that, do you then agree to honor the year long contract?" That statement is not professional. I finally said, "Fine, play the tape. I know what was said. I remember the reassuring conversation we had about your satisfaction guarantee. Play the tape." He then put me on hold. He finally came back on the phone and told me he was having some temporary technical difficulties.

4. When Ian called back the next time to get more money out of me, he started negotiating the amount. "If we look at lowering the contract by X% we can still cover you for the whole year." He then proceeded to lower the price some more as I sounded cooperative. I did not agree. I just wanted to see how low he would go. A professional company offering legitimate service would not respond this way.

Would you PLEASE recognize the odor of scam in all their actions??!!

Finally, when I pay for something, I expect to receive merchandise or a service. Clicksmart is supposed to provide service. They do not. Their Website is a simple pass through Website. I finally found them on the sixth page, last listing when I entered "contractor seattle washington" on Google. The company is NOT providing a service of value commiserant with the fee. They do not deserve to be paid.
