Took deposit for move, cancelled move, did not refund deposit

On 12-05-05, I hired the company to do a move for me. I prepaid them $400.00. The move was scheduled for 12/26/05. I told him I had to be out NO LATER THAN that date because I had to be in my new location on 12/27/05. He said no problem.

On 12/20, he was supposed to call me and give me an exact time that he would be there so someone could be there to meet him since I would already be gone. He didn't call. I called him and left multiple messages. I left multiple messages with dispatch. I then get a e mail on 12-26 that said that he had cancelled the move and that since it was less than 7 days before scheduled move date, I was not entitled to a refund.

I sent him another e mail that day and told him I had to have my things delivered and being Christmas time I could not find anyone else. He said he would call to reschedule me. He told me this on Dec. 29th. Knowing full well I had already moved to my new destination. And had to go without my belongings. Since I had to be out by the 27th.

On Friday Dec. 30th he called me to rescheduled my move for Jan 5th or 6th. I sent him an email and told him that I had already paid someone to move it to storage and I had to rebuy everything when I moved and I once again demanded my money back. This was his reply "Please This is enough. You have played games with me the entire time during this process. You signed paperwork stating that the deposit is only refundable prior to 7 days to your move.

You have told me the move was on and the move was off. (he cancelled the move. I never said I wasn't moving) It is not my fault you didn't have money to pay for your items to be moved. (I still have the receipt where I had the money order ready for him.) I have been nothing but nice an extremely customer friendly to you. I am not going to listen to anymore of your harsness or threats anymore. I will file a harrassment charge on you. I wish you the best and my the lord be with you. My thoughts and prayers are with you.

Please learn one thing from this you simply cannot force someone to be dishonest to you and give you answers that you want to hear. I told you from the beginning that I would not always tell you what you wanted to hear but one thing I would tell you is the truth. I am sorry you have choose not to use our service, but you have indeed caused us to spend numerous hours working for you. The deposit is again not refundable unless you cancel 7 days or more before your move date. The reason being there is tons of work that is involved in moving people's belongings and we did indeed work for you.

I was lied to from day 1.. I never cancelled the move he did. He did tell me in one conversation that it would take about 6 days to get my things. 400 miles. When I asked him why so long he said that they load up other peoples furniture and when they get a truck full, then they start delivering. I have EVERY email from me to him and it shows he is a lier and then he has the nerve to threaten harrassment charges on me. I filed a complaint with the BBB but it got me nowhere..
