In November Mc Clafferty got a contract with Lexington Design in Los Angeles Ca. To install cabinets in a 21 Forever clothing store in Pittsburgh and then in Morgantown WV. I have emails, which were submitted to the courts in Pittsburgh, to show the agreement for Mc Clafferty to pay me $18./hr. As a subcontractor for my tools and work. I worked with the main installation supervisor from Lexington Design, Los Angeles who made sure the cabinets were installed to perfect specifications guaranteed by Lexington. The supervisors from Los Angeles were Gary Hunter and Ian Swartz and may be reached for verification of this report at any time. They also kept track of my hrs. And one unskilled laborer that Mc Clafferty provided who was unpurposeful.
I finished the one installation in Pittsburgh and to the complete satisfaction of the supervisor in charge Lexington requested that I help their supervisor with another store in Morgantown WV. Mc Clafferty was paid by Lexington and I demanded to be paid in full then before driving my van and a few thousand dollars of my tools to West Virginia and back for 3 days. I was then paid for some 18 hrs and gas money or aprox $520. Mc Clafferty said only in cash because of disability, he was on crutches, and alot pain medication according to the laborer. There was no receipt, never again, I never take cash payments because I'm licensed and insured and my accountant doesn't allow it.
Against my better judgement, I drove to WV 3 days and worked as an assistant to the main supervisor of cabinet installations from Lexington Designs to finish the 21 forever store in a shopping mall. I had some special power tools that were necessary such as an $800. Sliding compound miter saw, rigid 18 volt drills and professional hot glue guns and pro grade caulking guns. Mc Clafferty again was not present on the site during the work and had no tools there. The project was again sucessfully completed to Lexingtons high standards.
I was forced to continually call Mc Clafferty for final payment of $484. For the 22 hrs installation in the Morgantown store, he refused to pay becoming extremely nasty and admitting that he has been through this before that I will never get the money and that he doesn't own any thing if I go to court. I have filed in court and the Magistrate recorded that Mc Clafferty evaded service at 6 different times. Mc Clafferty told me to contact the state administrations if I preferred which I have done. I contacted the IRS to report non reporting of income, I contacted the business bureau to report someone that may be working on disability and the DEA as his laborer remarked that Mc Clafferty had an unlimited perscription to pain medication. Mc Clafferty got paid for my hard work and believe me, I worked hard and honestly and accomplished a project well finished.
