"Dear Mr. Dirks:
This firm and the undersigned represent Mark and Blake with regard to severe damage caused by Allied to their home and property. We are directing this correspondence to you as the President and CEO due to the fact that the adjuster for Allied does not appear to have evaluated this claim seriously and has refused to cooperate and provide requested information to my clients. We are hopeful that upon your serious review of this matter that a beneficial resolution may be reached between the parties.

As you well know, the damage caused by Allied far exceeds the offer of settlement offered to my clients by the Allied Van Lines Claim Services. Not only did Allied cause severe and un-repairable damage to the property of my clients, but Allied also caused extensive damage to the home.

It is clear that Allied caused extensive damage to my clients property and it is clear that my clients purchased insurance up to $125,000.00 to cover the value of the property being moved. It is also clear through many taped conversations that my client has with Allied employees including the insurance adjuster, Richard Ferrero, Mike Padilla and you, that Allied admits fault and liability with regard to the extensive damage.

Further, not only did Allied cause extensive damage to my clients property, but many items were left behind and never provided to my clients, including, but not limited to, Queen size mattress and box springs, very expensive banana tree, all of Ms. Taylor's summer clothing and shoes, tools, ladders, company files, various pieces of art and all of the family Christmas items including decorations and memorabilia

Richard Ferreroa's specific statements were that he would provide the most experienced crew for this move. My clients chose Allied because they understood that Mr. Ferrero would make certain that the move was successful and because they believed that only experienced movers would be assigned to their move. My clients entered into a contract with Allied for $12,444.42, but the move actually cost $17,677.26, plus storage costs of $6,021.00. My clients specifically asked for an experienced crew for the move, but when they arrived at their destination, Allied breached its contract by failing to provide an experienced crew and it further failed to provide the proper number of workers to handle the large amount of property.

In moving out of their home, Allied had employed Seven (7) movers and it took approximately 24 hours to pack and move the items over a two day period. When Allied arrived at their new destination, it provided two employees to handle the move into my clients new home. The move was so large that the contents were in a semi truck and an over-flow truck. The Allied movers severely damaged my clients home and property due to their lack of experienced workers and lack of the correct number of workers needed to successfully complete the move.

My clients immediately contacted Allied upon learning that two employees would be moving their items into their home. Valisha took the call during the move, who indicated that she would provide additional employees to handle the difficult task. Ms. Valisha specifically told my clients that additional workers would be located and sent to their home and that Ms. Valisha would call back to confirm. Ms. Valisha never contacted my clients again and no additional workers were provided. On June 2 and June 3 respectively my client spoke to Valisha, you and Mike Padilla regarding the problem and issues relating to damage being caused by the Allied workers to both property and the home.

Mr. Padilla and Ms. Valisha both admitted that the workers were not experienced and neither could explain why Allied sent the driver, Richard Casas, who had no experience in out of state moves. Further, Mr. Casas arrived to deliver the furniture at the new location without a crew. Mr. Casas arrived in my clients new town of residence and hired two workers who were apparently not even employed by nor employees of Allied. It is unclear as to the identity of who the two individuals that Mr. Casas hired were and it is highly likely that they were day laborers.

Moveover, these individuals refused to return the next day. On the second day, Mr. Casas arrived two hours late with two different individuals. One of these individuals consistentoly threatened to beat the - out of Mr. Casas in front of a 10 year old resident of the new house. I request that you disclose the full names, contact information and resumes for the crew hired to move my clients furniture.

Selby Furniture was sent to my clients home to take photos of the damage. Selby took over one hundred pictures and said that the damage caused by Allied was the worst damage that they had ever seen in their 30 plus years in the business. Selby wrote a report stating that the damage was bad and that they even identified extensive damage to the walls; however that report was never provided to my clients even after they requested a copy be provided. Additionally, the repairs made by Selby were not satisfactory to my clients and many of the items were not repaired at all.

The extensive damage caused by Allied to my clients home and property exceeds the amount of the $125,000.00 insurance purchased by my clients for the move. I enclose for your review and file, copies of the damaged items, and you have the additional evidence provided to you by Selby Furniture to evaluate this claim. I request that you provide a copy of the photos and the report to my office no later than ten (10) days from the receipt of this letter. Further, I request that you reevaluate this claim as the following accurately represents the damage caused by Allied to my clients:

1. Payment for damages to property: $79,987.56
2. Payment for damages to the walls: $ 5,000.00
3. Reimbursement for moving costs: $23,798.26
4. Payment for lost items: $ 5,000.00
5. Reimbursement for attorneys fees: $ 5,000.00

Total payment: $128,785.82

The maximum reimbursement allowed pursuant to the Allied contract is $125,000.00. Please remit payment in the amount of $125,000.00 to my office within ten (10) days from receipt of this letter. Should no response be received within the time provided, my clients will pursue their legal rights against Allied and will seek their attorneys fees and costs and punitive damages."

DO NOT EVER USE THIS COMPANY. If you do I promise you that you will regret it!!!
