A) Breach of Contract i.E.: discrepancies in contract.
1) Checks are held back for the first two weeks that you run.
(Line 6 Paragraph 1) UNTRUE!
Checks are held for three weeks, if you're lucky and get one. Four weeks for me.
2) Paper work and fuel receipts must be turned into Panther, at the latest Monday of every week. (Line 2 Paragraph 1) UNTRUE!
They must be scanned in to Panther by 12PM Sunday. I did as I was told, scanned my paperwork in on Monday and didn't get paid until the fourth week because the paperwork was in late. Tina the office manager also verified over the phone that the deadline was Monday.
Paperwork was always confidently being misplaced, not legible ECT causing me to never get paid for the loads.
B) Theft by deception i.E.: Stolen Payroll
When I first started driving for Chris Williamson DBA Infinity Transport pulling loads for Panther II, I was offered loads paying $1.85 a mile plus FSC. I split the $1.85 50/50 with Chris. This is qualcomm verifiable. After my third load I was informed by Panther II that a mistake had been made with the cpm. It should have been a $1.60. They apologized and said I would be paid the $1.85 for the miles I ran on my first three loads because it was their mistake not mine and both parties agreed to the load assignment and cpm and fsc via the qualcomm. When I got the pay receipt for said loads, Infinity only paid me a $1.55 for the loads. When I questioned Chris Williamson about this he said that Panther II didn't pay him. I called Panther II and they said they did. It doesn't really matter though because I accepted that load assignment at $1.85 and that is legal binding. Now all this was on my first pay check, four weeks into working for Infinity and Panther.
I was agreeing to loads paying $1.60 cpm and was receiving from Infinity $1.55; this is a 5 cent discrepancy that is not mentioned in my contract. Or is this mentioned on the load assignment sent over the quallcomm. If I agree to a $1.60 cpm I should get $1.60 cpm.
The first weeks gross for the truck was $1,292.35. I got $404.40
Week Two $2,417.30 I got $503.80
Week Three $1,658.40 I got $147.17
Totals Truck $5,368.05
I got $1,055.37
Now show me any 50 percent for starters.
I worked for Chris Williamson and Infinity Transport for 1 and 1/2 months and that's what I received. The miles sucked because the truck was in the shop 21 days of the 1 1/2 mths and I was in three different trucks. Plus Panther II would send me to areas where there where no loads and I sat for days on end once I sat for a week having to find my own back haul to get home.
Its was like pulling teeth to get Chris to fix his truck. My wife and I were stuck for days in the southern heat without A/C because Chris would fix the truck or they wouldn't answer the phone.
Getting gas loaded on your comdata card was a joke. I got penalized for having a late p/u and delivery because no one would answer the phone so I could get fuel.
Chris also wanted me to operate the truck in an unsafe manner in violation of DOT regulations.
Panther II knows about this guy and his BS and still keeps sending drivers to him. I think its time we put a stop to it. Join me in a multi action law suit if Chris and Infinity or Panther II has screwed you out of money.
I'm just looking for JUSTICE and I'm going to get it and my MONEY!
You shouldn't have to work harder to get your pay than you did to earn it!!!
