Just recently Kasamba informed its experts they would receive 1099 forms for the first time since the company has been in existence.

Since Kasamba is now being recognized as a US entity by the IRS, this also makes them subject to US labor and tax laws. As anyone who has been a Kasamba expert knows, Kasamba DOES have an employer/employee relationship with its experts. The IRS is very interested in knowing about companies who try to pass employees off as independent contractors to avoid paying social security and other taxes, when indeed these people are really employees. There have been numerous lawsuits about this issue, including one that cost Microsoft millions of dollars. Microsoft tried to pass off people who they had an employer/employee relationship with as independent contractors. The courts agreed they were indeed employees of Microsoft and those people were awarded millions in a class action lawsuit.

Kasamba is doing this because it allows them to control experts the way an employer would, while at the same time allowing them to place all the tax burden on experts as well. Its a win-win situation for them. Kasamba cannot have it both ways. The IRS is very interested to know about companies trying to pass off legitimate employees as independent contractors. When you read IRS form SS-8 you'll see that Kasamba is indeed acting as an employer to experts. Kasamba has behavioral and financial control over its experts, which is how the IRS defines an employer/employee relationship. This means they should be withholding taxes from experts earnings as well as paying social security tax and worker's compensation tax for experts.

It should also be noted that many US states attorney general's offices would be very interested to hear stories about Kasamba experts and clients who are being victimized by their unethical practices. Kasamba should no longer be able to get away with treating clients and experts this way.
