On February Ms. Wind advertised a lifetime breeding contract for her young Arabian stallion, Windsong Firefrost AHA 609803, was for sale for $2500. I called her on February 22 about purchasing the contract. She said the terms of the contract were $500 down (paid check #1430), with payments of $100 per month until paid in full. Since the stallion wouldn't be old enough to breed until a payment plan was fine. I got the contract from Ms. Wind and mailed signed copies back. There was nothing about no refunds in the contract.
Over the next few months, Ms. Wind kept telling me that payments were misdelivered or arrived late, but that it wasn't a problem since she knew I had mailed them. I sent payment on the 3rd of each month, and replaced any missing checks. So payments made and CASHED were $300 (check #1571 for April, May and July payments) and $100 (check #1456 for June payment).
In August Ms. Wind and I had an argument about another transaction, unrelated to this one on the phone. As of August 6th, Ms. Wind has refused all phone calls/emails from me trying to resolve this.
On Aug 3rd I had mailed our Aug payment. On Aug 25th, I got the envelope back unopened and marked "return to sender". I mailed a letter on Aug 25th requesting a reason for the returned payment and assurances that all was well with Windsong Firefrost's contract. On Oct 13th, I got that letter returned and unopened as well.
On Oct 13th, I mailed letters with delivery confirmation to Ms. Wind demanding a refund of our $900 by Dec 8th, since she refused our payments thus voiding our contract. Ms. Wind continues to refuse communications from us and has not refunded the $900.
In October we also learned Ms. Wind was suspended from AHA as was Windsong Firefrost, making the contract void as well since Frost was guaranteed registered with the Arabian Horse Association.
In February I filed a civil suit against Ms. Wind for our $900 and all court fees. The Auroro, CO police tried to serve her and found out that her "official address" is an empty office building. They then tracked her down to Parker, CO where the farm the horses are on and the house she gets her mail at both deny that she lives/boards there or that they have ever heard of her. The Sherrif has attempted to serve her with the court papers 4 times from February to December.
In Novemeber 2006 she transfered most of her horses to The Elements Arabians owned by a James Donald. Stephanie Wind's boyfriend is named James and I belive this is an attempt to hide her assets as several people are trying to sue her as James Donald's official address is in the same empty office building as Ms. Wind's.
We are still trying to track her down to have her served with the court papers, as are several other people.
