Complaint / Review
Cingular Wireless
Misrepresentation, Fraud, Breach of Contract, All Locations USA

When I decided to migrate from AT&T over to Cingular, I understood I would be entering a 2 year contract. I asked about a 2nd phone and it was to be just under $10 per month as an "Add On" only! Not a separate contract. I was assured I could cancel the 2nd phone at any time with NO penalty or charge.

Cingular Changes Contract Terms: When the time came and I wanted to drop the 2nd phone, I was then told I would be hit with an Early Termination Fee!

Before I agreed to take Cingular, another specific question was if I relocate, can I change my phone number for free without any penalty or charges. Cingular assured me no problem and not penalty or charge - that I would simply contact the "relocation department" and it is done all the time.

Cingular Changes Contract Terms 2nd Time: I relocated to another state. I called to change my phone numbers. Cingular sent 2 NEW bad sim's cards which pushed me past a deadline date to keep my numbers. I was then forced to drive to a Corporate Store for assistance some 30 miles away. After a long wait, the rep was able to finally get my old numbers back and numbers changed. She stated for my inconvenience, my November bill would be credited in the amount of $59.86 and NOT to pay the November billing. I expressed concern over how Cingular seems to keep telling me one thing then the computer notes change or get deleted. I intentionally had the Text Messaging option turned "OFF". She stated she personally put in all the changes for everyone else in Cingular to see.

About 2 weeks later and in the morning, my cell phone rings. Message read that if I did not just sign on with Cingular's "on line" account service, to call an 877 number (Fraud Department). So I did. Was sent from one dept to another for an hour. Demanded my minutes be credited as Cingular instructed me to call a land line and not *611. Rep said she would. The guy in the Fraud Dept said no fraud, but I should talk to billing about my charges - said they were high. I was transferred and found out in just 2 weeks after being given a $59 credit, my bill was now over $670! I was told I was now being charged 2 Early Termination Fees (one for each line - I never terminated my contract), plus 2 Reinstatement Fess, plus other charges. Total was over $600. I stongly objected and this new Rep said she would back off the Early Term & Reinstatment Fees. Now my bill was over $200. Still objected. She finally reduced my bill to $113.

I immediately sent e-mails out to the President, and other higher ups on Friday after being guided to their e-mail sites.

I understand there are Class Action Lawsuits involving in appropriate Early Term Fees. I will be calling to see about joining. Highly recommend others do same.
